Book excerpt: The Sunni schools of law are named for jurisprudents of the eighth and ninth centuries, but they did not actually function so early. The main division at that time was rather between adherents of ra'y and ḥadīth. No school had a regular means of forming students. Relying mainly on biographical dictionaries, this study traces the constitutive elements of the classical schools and finds that they first came together in the early tenth century, particularly with the work of Ibn Surayj (d. 306/918), al-Khallāl (d. 311/923), and a series of ḥanafī teachers ending with al-Karkhī (d. 340/952). Mālikism prospered in the West for political reasons, while the ẓāhirī and Jarīrī schools faded out due to their refusal to adopt the common new teaching methods. In this book the author fleshes out these historical developments in a manner that will be extremely useful to the field, while at the same time developing some new and highly original perspectives.

Informed by classical Arabic-Islamic rhetorical theory, the author examines Arabic documents attributed to the ʿAbbāsid Caliph al-Maʾmūn (r. 813-833), whose rule coincided with the maturation of classical Islamic political thought and literary culture. She demonstrates how Qurʾānic referencing functions as tropological exegesis, whereby verses in the Qurʾān are reinterpreted through the lens of subjective experience. At the same time socio-historical experiences are understood in terms of the Qurʾān’s moral typology, which consists of interrelated polarities that define good and bad moral characters in mutual orientation. Through strategic deployment of scriptural references within the logical scheme of rhetorical argument, the Caliph constructs moral analogies between paradigmatic characters in the Qurʾān and people in his social milieu, and situates himself as moral reformer and guide, in order to persuade his audiences of the necessity of the Caliphate and the religio-moral imperative of obedience to his authority. The Maʾmūnid case study is indicative of the nature and function of Qurʾānic referencing across historical periods, and thus contributes to broader conversations about the impact of the Qurʾān on the shaping of Islamic civilization. In einer Vergleichsanalyse, die auf der Prämisse einer massiven Interaktion der Kulturen in jener Zeit basiert, lässt sich nun nachweisen, dass das erste monumentale Rechtswerk im Islam, die Zāhir ar-riwāya des Šaybānī, strukturell und inhaltlich auf dem Rhēton beruht – einer griechischen Version jenes Regelwerkes, das später in Europa als Corpus Iuris Civilis Verbreitung fand. Inspiriert durch die byzantinische Reichsrechtsidee kodifizierten muslimische Staatsjuristen in Bagdad das islamische „Reichsrecht“, das aber angesichts der Opposition frommer Überlieferer durch Traditionen legitimiert werden musste. Nachdem sich das Reichsrecht in weiten Teilen des Kalifats etabliert hatte, bewirkte der revolutionäre Triumph der Orthodoxie Mitte des 9. Jahrhunderts dessen Übergang in ein Juristenrecht, das nun in den Händen unabhängiger Gelehrter lag.
