Tra le novità normative si segnala innanzitutto la nuova disciplina dell’espropriazione presso terzi, radicalmente trasformata dalla legge 24 dicembre 2012, n. 228 che ha modificato gli artt. 543, 547, 548 e 549 c.p.c.. Le norme riformulate hanno previsto il riconoscimento “presunto” della esistenza del credito da parte del terzo pignorato ed hanno modificato la natura dell’accertamento dell’obbligo del terzo. I capitoli del Manuale che trattano del “pignoramento presso terzi” sono stati, quindi, riscritti. Il legislatore ha introdotto altre disposizioni che hanno avuto incidenza sulla materia dell’esecuzione forzata: quelle che hanno abrogato le “tariffe forensi” e trasformato le modalità di determinazione delle spese e dei compensi; le norme che hanno modificato ulteriormente, in maniera profonda, l’esecuzione esattoriale; il “decreto del fare”, convertito dalla n. 98 del 2013, che ha riformulato la disciplina della “mediazione”, prevedendo un particolare tipo di titolo esecutivo; le nuove previsioni in materia di sequestro, confisca, gestione ed alienazione dei beni nella disponibilità di appartenenti ad organizzazioni mafiose, introdotte dalla “legge di stabilità” del 2012; la nuova disciplina della certificazione di qualificazione energetica degli immobili e quella delle aree destinate a parcheggio; le disposizioni sulle tariffe notarili di cui al decreto ministeriale 3 agosto 2013 n. 106 e sulla rideterminazione dell’ambito territoriale di attività dei Notai; il recepimento delle direttive sul titolo esecutivo europeo. A systematic approach is required to ensure that appropriate policies are developed and the benefits of reform fully realised. This report presents sectoral analyses on agriculture, fisheries, water, energy and transport. It proposes a checklist approach to identifying and assessing environmentally harmful subsidies. It also identifies the key tensions and conflicts that are likely to influence subsidy policy making. Can the political and economic impediments to subsidy reform be overcome?
