In any well-established democratic society, people have the right to free speech as well as the right to equal treatment and protection under the law. But when one person's speech harms another person on the basis of race, ethnicity, religion, gender, or sexual orientation, it may qualify as hate speech and be subject to restriction. Cortese argues that restricting hate speech does not violate the guiding principle behind the First Amendment, but he is not eager to see more lawsuits. Effective restriction, he asserts, should not focus on litigation but on speech codes and moral education. Is there a limit to freedom of expression in a democracy, and if so, where should the line be drawn? In attempting to answer that question, Cortese makes a solid case for paying attention to context and common sense. Some hate speech is more reprehensible than others; not all discriminatory statements are equally serious. There is a discernible difference between an offensive remark and an incitement to commit murder. There is also a fundamental distinction between intentional and unintentional discrimination. In this book, Cortese rethinks some of the issues that have been silenced in ways harmful to many—especially those that have been brutalized, oppressed, manipulated, dominated, segregated, and disadvantaged. We should recognize the grave injuries inflicted by hate speech and the potential tensions between legal solutions to those injuries and the First Amendment. We must push for moral education, educational speech codes, and when necessary, a formal, legal-structural response to hate speech in order to reinforce our commitment to tolerance as a value.

For constitutionalists, regulation of hate speech violates the First Amendment and damages a free society. Against this absolutist view, Jeremy Waldron argues powerfully that hate speech should be regulated as part of our commitment to human dignity and to inclusion and respect for members of vulnerable minorities. Causing offense—by depicting a religious leader as a terrorist in a newspaper cartoon, for example—is not the same as launching a libelous attack on a group’s dignity, according to Waldron, and it lies outside the reach of law. But defamation of a minority group, through hate speech, undermines a public good that can and should be protected: the basic assurance of inclusion in society for all members. A social environment polluted by anti-gay leaflets, Nazi banners, and burning crosses sends an implicit message to the targets of such hatred: your security is uncertain and you can expect to face humiliation and discrimination when you leave your home. Free-speech advocates boast of despising what racists say but defending to the death their right to say it. Waldron finds this emphasis on intellectual resilience misguided and points instead to the threat hate speech poses to the lives, dignity, and reputations of minority members. Finding support for his view among philosophers of the Enlightenment, Waldron asks us to move beyond knee-jerk American exceptionalism in our debates over the serious consequences of hateful speech.

As "hate speech" has no generally accepted definition, we hear many incorrect assumptions that it is either absolutely unprotected or absolutely protected from censorship. Rather, U.S. law allows government to punish hateful or discriminatory speech in specific contexts when it directly causes imminent serious harm. Yet, government may not punish such speech solely because its message is disfavored, disturbing, or vaguely feared to possibly contribute to some future harm. "Hate speech" censorship proponents stress the potential harms such speech might further: discrimination, violence, and psychic injuries. However, there has been little analysis of whether censorship effectively counters the feared injuries. Citing evidence from many countries, this book shows that "hate speech" are at best ineffective and at worst counterproductive. Therefore, prominent social justice advocates worldwide maintain that the best way to resist hate and promote equality is not censorship, but rather, vigorous "counterspeech" and activism.

The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue (e.g., reciprocity, equality, and mutual respect). Online hate speech has become a major form of human rights abuse, with serious, sometimes tragic consequences, both online and offline. Hate speech cannot be allowed to proliferate without being challenged and exposed in its nature: prejudicial views on social groups combined with fake news which feed phobias and fears, seem attractive as narratives. Narratives give a meaning to information presented because they connect with what people believe, or want to believe in.Their widespread presence online accredits their claims for legitimacy. But narratives are rarely the truth and never the whole truth. When they are used to oppress people, as in hate speech, the fundamentals of a pluralistic and democratic society are undermined, and the lives and dignity of people are at risk. Counter narratives are thus needed to discredit and deconstruct the narratives on which hate speech is based. Alternative narratives are also needed to reinforce positive values and perspectives which support human rights and democratic citizenship, such as solidarity, respect for diversity, freedom and equality. Young people need to occupy online public space with positive narratives based on hope and love. This manual presents communicative and educational approaches and tools for youth and other human rights activists to develop their own counter and alternative narratives to hate speech. It is designed for working with young people from the age of 13, and is based on the principles of human rights education and youth participation. Anyone can take action against speech. By providing insights into hate speech and human rights, and a methodology for producing counter narratives, We Can makes that action easier, more effective and positive. The Council of Europe launched the No Hate Speech Movement campaign to mobilise young people for human rights online and to combat hate speech. Education plays a central role in the campaign. This manual complements Bookmarks - A manual for combating hate speech online through human rights education, also published by the Council of Europe.

Some significant areas of study have been the origins of hate speech in past and modern societies around the world; the way hate speech paves the way for harmful social movements; the socially destructive force of propaganda; and the legal responses to hate speech. On reviewing the literature, one major weakness stands out: hate speech, a crime perpetrated primarily by malicious and damaging language use, has no significant study in the field of linguistics. Historically, pragmatic theories have tended to address language as cooperative action, geared to reciprocally informative polite understanding. As a result of this idealized view of language, negative types of discourse such as harassment, defamation, hate speech, etc. have been neglected as objects of linguistic study. Since they go against social, moral and legal norms, many linguists have wrongly depicted those acts of wrong communication as unusual, anomalous or deviant when they are, in fact, usual and common in modern societies all over the world. The book analyses the challenges legal practitioners and linguists must meet when dealing with hate speech, especially with the advent of new technologies and social networks, and takes a linguistic perspective by targeting the knowledge the linguist can provide that makes harassment actionable.
