  • Author : Martha Minow
  • Publisher : Oxford University Press

Download or read book In Brown s Wake written by Martha Minow and published by Oxford University Press. This book was released on 2010-08-17 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is the legacy of Brown vs. Board of Education? While it is well known for establishing racial equality as a central commitment of American schools, the case also inspired social movements for equality in education across all lines of difference, including language, gender, disability, immigration status, socio-economic status, religion, and sexual orientation. Yet more than a half century after Brown, American schools are more racially separated than before, and educators, parents and policy makers still debate whether the ruling requires all-inclusive classrooms in terms of race, gender, disability, and other differences. In Brown's Wake examines the reverberations of Brown in American schools, including efforts to promote equal opportunities for all kinds of students. School choice, once a strategy for avoiding Brown, has emerged as a tool to promote integration and opportunities, even as charter schools and private school voucher programs enable new forms of self-separation by language, gender, disability, and ethnicity. Martha Minow, Dean of Harvard Law School, argues that the criteria placed on such initiatives carry serious consequences for both the character of American education and civil society itself. Although the original promise of Brown remains more symbolic than effective, Minow demonstrates the power of its vision in the struggles for equal education regardless of students' social identity, not only in the United States but also in many countries around the world. Further, she urges renewed commitment to the project of social integration even while acknowledging the complex obstacles that must be overcome. An elegant and concise overview of Brown and its aftermath, In Brown's Wake explores the broad-ranging and often surprising impact of one of the century's most important Supreme Court decisions.

Book Historical Redress

  • Pages : 186 pages

Download or read book Historical Redress written by Richard Vernon and published by Bloomsbury Publishing. This book was released on 2012-07-19 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: Should the British Museum return the Elgin Marbles to Greece? Should settler societies in North America and Australasia compensate the aboriginal peoples whom they dispossessed? Should Israel have accepted Germany's compensation for Nazi extermination policies? The last twenty years have seen a remarkable surge of political and ethical interest in historical redress - that is, the righting of old wrongs. In this fascinating book, Richard Vernon argues that whatever the kind of redress that's at issue, and whether the wrong is large or small, an important philosophical issue arises. Exploring recent and high profile cases, Vernon focuses on the issue of responsibility. Responsibility isn't something inherited, like property or one's DNA. How, then, can it fall to one generation to make good the wrongs done by another? The book addresses all the main issues and arguments relating to justice, memory, apology and citizenship, and concludes by arguing for a forward-looking approach that focuses on the right of future generations to live just lives.

Book A Treatise on Efficacy

  • Author : François Jullien
  • Publisher : University of Hawaii Press
  • Release : 2004-04-30
  • ISBN : 9780824828301
  • Pages : 226 pages

Download or read book A Treatise on Efficacy written by François Jullien and published by University of Hawaii Press. This book was released on 2004-04-30 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this highly insightful analysis of Western and Chinese concepts of efficacy, François Jullien subtly delves into the metaphysical preconceptions of the two civilizations to account for diverging patterns of action in warfare, politics, and diplomacy. He shows how Western and Chinese strategies work in several domains (the battlefield, for example) and analyzes two resulting acts of war. The Chinese strategist manipulates his own troops and the enemy to win a battle without waging war and to bring about victory effortlessly. Efficacity in China is thus conceived of in terms of transformation (as opposed to action) and manipulation, making it closer to what is understood as efficacy in the West. Jullien’s brilliant interpretations of an array of recondite texts are key to understanding our own conceptions of action, time, and reality in this foray into the world of Chinese thought. In its clear and penetrating characterization of two contrasting views of reality from a heretofore unexplored perspective, A Treatise on Efficacy will be of central importance in the intellectual debate between East and West.

Download or read book New Paths of the Law written by Roscoe Pound and published by The Lawbook Exchange, Ltd.. This book was released on 2012-04 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: New Paths Dissects the Legal Trends of Late 1940s Notable for their conservatism, which became more pronounced in subsequent publications, these lectures reflect on developments in the international legal order during the late 1940s. Pound detected three legal "paths" those of liberty, humanitarianism and authoritarianism. The first, which he endorses, seeks to realize a maximum of free individual self assertion. Legal humanitarianism, which he criticizes heavily, is the expansion of injury law to include social redress and consumer protection. His antipathy toward the authoritarian path goes beyond a condemnation of authoritarian regimes like the Soviet Union to a rejection of any form of social legislation, such as socialized medicine or state-run pensions. These lectures were delivered at the University of Nebraska (where Pound had been dean of the College of Law from 1902-1907) and marked the establishment of the Roscoe Pound Lectureship Series. "This book, . . . by its very thinness may succeed in luring attention away from competing attractions, since here one may, with the expenditure of only a little time, obtain the reaction of one of the giants of jurisprudence to our confused, complex and turbulent modern legal scene." --North Carolina Review 93 (1950-1951) 29 Roscoe Pound [1870-1964] was a pre-eminent legal educator, scholar and prolific author. A professor at Harvard Law School for most of his career, and its dean from 1916-1936, he taught throughout the world in his later years. His five volume Jurisprudence (1959) is considered one of the most important contributions to the world's legal literature of the twentieth century.
