Book excerpt: Throughout the world there is evidence of mounting interest in marine resources and new maritime industries to create jobs, economic growth and to help in the provision of energy and food security. Expanding populations, insecurity of traditional sources of supply and the effects of climate change add urgency to a perceived need to address and overcome the serious challenges of working in the maritime environment. Four promising areas of activity for ‘Blue Growth’ have been identified at European Union policy level including Aquaculture; Renewable Energy (offshore wind, wave and tide); Seabed Mining; and Blue Biotechnology. Work has started to raise the technological and investment readiness levels (TRLs and IRLs) of these prospective industries drawing on the experience of established maritime industries such as Offshore Oil and Gas; Shipping; Fisheries and Tourism. An accord has to be struck between policy makers and regulators on the one hand, anxious to direct research and business incentives in effective and efficient directions, and developers, investors and businesses on the other, anxious to reduce the risks of such potentially profitable but innovative investments.The EU H2020 MARIBE (Marine Investment for the Blue Economy) funded project was designed to identify the key technical and non-technical challenges facing maritime industries and to place them into the social and economic context of the coastal and ocean economy. MARIBE went on to examine with companies, real projects for the combination of marine industry sectors into multi-use platforms (MUPs). The purpose of this book is to publish the detailed analysis of each prospective and established maritime business sector. Sector experts working to a common template explain what these industries are, how they work, their prospects to create wealth and employment, and where they currently stand in terms of innovation, trends and their lifecycle. The book goes on to describe progress with the changing regulatory and planning regimes in the European Sea Basins including the Caribbean where there are significant European interests. Book excerpt: The growing quantity of plastic waste in the marine environment including abandoned, lost or otherwise discarded fishing gear (ALDFG) is a global problem. A particular feature of ALDFG is the potential of some gears to carry on fishing for many months or even years. The study examines legal responses to ALDFG in the context of marine fisheries. After discussing the nature of the problem of ALDFG and some of the reasons why fishing gear is abandoned, lost, or otherwise discarded, the study examines the response of the international community to ALDFG. A key finding is that ALDFG is at the same time, a fishing issue, a navigation problem (of vessel source pollution) and an environmental problem with the resulting involvement of FAO, IMO and UNEP as well as the UN General Assembly. After examining potential legal approaches to the problem, the study then describes the basic legal and institutional arrangements in four case study jurisdictions that have adopted legal measures to address ALDFG, namely Australia, the European Union and its Member States, Norway and the USA finding once again the tripartite responsibility of fisheries, navigation and environment ministries/agencies. The inter-sectoral nature of ALDFG suggests the need for a collaborative and coordinated approach. While not all of the case study jurisdictions make use of all ten of the individual legal measures identified, the case studies also clearly show that ALDFG is a problem that is susceptible to a legal response at the national or regional level including through the use of extended producer responsibility schemes, various reporting requirements and gear standards. Legal tools to address the problem of ALDFG clearly exist. The extent to which some, or all, of them are necessary or appropriate in a given context at national, regional or global level is not ultimately a legal question but a political one.

The question is asked: does the liability system give the potential polluter incentives to take precautionary measures to avoid pollution or to reduce the possibility of pollution? The international regime on civil liability for marine oil pollution rests on the International Convention on Civil Liability for Oil Pollution Damage (CLC) and the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage (Fund Convention). However, the world’s biggest oil consumer and importer – the United States – has ratified neither, preferring its own Oil Pollution Act of 1990 (OPA), and China – currently the world’s second oil-consuming country – has not ratified the Fund Convention. Thus it is reasonable to compare the three regimes – international, US, and China – as such a comparative study may reveal some advantages or disadvantages among the three systems. Among the issues raised and tackled head-on by the author are the following: whether the contents of international conventions can be considered as the result of the influence of the various interest groups involve; overview of the regulations of marine pollution; technical standards, rules for operation, professional criteria; to what extent a state may take action against trans-boundary polluting activities; what liability a state may incur for non-action or non-effective action; significance for liability of the charter-party, generally considered the evidence of the hire of a ship, and the bill of lading, considered the evidence of the contract of carriage of goods by sea; the crucial role of the so-called ‘International Group’ of 13 Protection and Indemnity (P & I) Clubs, non-profit organizations specializing in liability insurance; the main international players – the International Maritime Organization (IMO), the Comité Maritime International (CMI), and industry organizations such as INTERTANKO and the Oil Companies International Marine Forum (OCIMF); the particular regime on offshore facility pollution liability in the United States; port state control; criminal liability; and EU and other regional initiatives. In addition, a detailed study of the Erika case reveals some of the rationale for many of the persistent features of marine pollution liability regimes. The well-thought-out legal and economic analysis provided in this book, along with its clearly stated policy recommendations and constructive perspectives for future development of the liability system, will be immeasurably valuable to lawyers and policymakers active in this highly visible area of international law.

The new estimates assess these 'sunken billions' at $83 billion annually. The report further shows that a clear path can lead to the recovery of these considerable losses, including through significant reduction in global fishing overcapacity. A breakdown between regions is also included, showing that the effort needed to achieve this reform will not be felt equally throughout the world. While the cost of such reform will likely be high, the expected benefits include an increase in biomass by a factor of 2.7, increase in annual harvests by 13 percent, and a 30-fold increase in annual net benefits accrued to the fisheries sector (from $3 billion to $86 billion annually). This urgent call for action is reinforced by the impacts of climate change on fish stocks and fisheries worldwide.

Book excerpt: World Development Report 1994 examines the link between infrastructure and development and explores ways in which developing countries can improve both the provision and the quality of infrastructure services. In recent decades, developing countries have made substantial investments in infrastructure, achieving dramatic gains for households and producers by expanding their access to services such as safe water, sanitation, electric power, telecommunications, and transport. Even more infrastructure investment and expansion are needed in order to extend the reach of services - especially to people living in rural areas and to the poor. But as this report shows, the quantity of investment cannot be the exclusive focus of policy. Improving the quality of infrastructure service also is vital. Both quantity and quality improvements are essential to modernize and diversify production, help countries compete internationally, and accommodate rapid urbanization. The report identifies the basic cause of poor past performance as inadequate institutional incentives for improving the provision of infrastructure. To promote more efficient and responsive service delivery, incentives need to be changed through commercial management, competition, and user involvement. Several trends are helping to improve the performance of infrastructure. First, innovation in technology and in the regulatory management of markets makes more diversity possible in the supply of services. Second, an evaluation of the role of government is leading to a shift from direct government provision of services to increasing private sector provision and recent experience in many countries with public-private partnerships is highlighting new ways to increase efficiency and expand services. Third, increased concern about social and environmental sustainability has heightened public interest in infrastructure design and performance.
