Download or read book Better Regulation in EU Contract Law written by Esther van Schagen and published by Bloomsbury Publishing. This book was released on 2019-12-26 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first to provide a critical investigation of EU better regulation from the perspective of EU contract law. The Commission's 'New Deal for EU Consumers' is one of the first EU contract law initiatives to implement both the newly revised Better Regulation Guidelines and the newly introduced combined evaluation of multiple Directives in the form of a 'fitness check'. This offers an opportunity to explore difficulties and best practices at a national level, as demonstrated by experience with the EU's Unfair Terms Directive. Both the fitness check and the impact assessment accompanying the New Deal should facilitate critical reflection on the design of EU contract law. This book addresses key questions. Do impact assessments favour business interests at the expense of a high level of consumer protection? Is the evaluation of EU contract law and the analysis in impact assessments in line with scientific standards? Has the fitness check revealed difficulties and success stories with EU measures at national level, and thereby facilitated an in-depth scrutiny of the design of EU contract law? Ultimately, is the potential of better regulation being realised?

Download or read book Sustainable Development and Governance in Europe written by Pamela M. Barnes and published by Routledge. This book was released on 2013-06-26 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the evolution of the sustainability discourse in the European Union, exploring the conditions necessary for sustainable development to move from a conceptual model into a model for action for strategic decision makers at all levels of governance. This book questions the extent to which the discourse on sustainability has become embedded into governance structures in Europe. It focuses on the importance of the nature of the language of the political discourse on sustainability and how ideas are communicated amongst the actors and stakeholders in the policy making process, as well as assessing the conceptual, political, institutional and operational barriers apparent across the European geographic region. Drawing case studies from numerous policy areas including climate change, EU emissions trading scheme, renewable energy, nuclear energy, the European integrated energy market, transport mobility, and environmental protection, expert contributors unveil a narrowing of the discourse on sustainability that has taken place in Europe. However, a considerable discontinuity remains between the economic and environmental objectives of sustainable development, and the authors argue that it is essential that conditions for a dynamic discourse, open to multiple participants, are developed. Sustainable Development and Governance in Europe will be of strong interest to students and scholars of comparative politics, governance, sustainable development and environmental politics and studies.

Download or read book Preventing Radicalisation and Terrorism in Europe written by Maria Luisa Maniscalco and published by Cambridge Scholars Publishing. This book was released on 2019-09-19 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Within the general framework of the European TRIVALENT project, the comparative analysis presented here focuses, alongside policy measures taken at EU level, on counter-terrorism and counter-radicalisation policies implemented by five European countries; namely, Belgium, France, Italy, Spain and the United Kingdom. These case studies with their peculiarities and differences offer insights into the role of long-term and structural factors in defining counter-terrorism and counter-radicalisation policies, and highlight the influence that specific occurrences can have. The volume analyses different types of public policies, including repressive, preventive, legal and administrative measures, together with the role of civil society in preventing and mitigating radicalisation processes. The book offers an updated and critical assessment of the main anti-terrorism and anti-radicalisation policies of the five aforementioned countries, and their strengths and weaknesses, identifying possible evolutionary lines and proposing a series of recommendations.
Download or read book Europeanisation and the Transformation of EU Security Policy written by Petros Violakis and published by Routledge. This book was released on 2018-05-15 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: The aim of this study is to examine the extent to which the end of the Cold War led to Europeanisation in the Common Security and Defence Policy (CSDP). The analysis takes into consideration previous studies on Europeanisation and its impact on the transformation of national security and defence, and attempts to account for the development of Europeanisation and related mechanisms. These mechanisms, which have been described as framing mechanisms and negative integration, incorporate all the major relevant factors identified here (i.e. a common Strategic Culture, new security identity, domestic political decision-making, industrial base and defence-spending decline) that contributed to the realisation of the CSDP. The relevance of these factors for CSDP Europeanisation is examined through an historical and empirical analysis, and the relationship between the CSDP and North Atlantic Treaty Organization (NATO) is also explored. This approach facilitates analysis of the debate concerning the emergence of the CSDP and throws light on the political shift that led European Union (EU) leaders to support the CSDP. Another aspect of this study is the empirical examination of the dynamics and limitations of the European defence sector. The changes which took place in this sector facilitated the emergence of the CSDP and are therefore analysed in the light of globalisation issues, economies of scale, economic crises, military autonomy, new security strategy and Research and Development (R&D) impact. This book will be of interest to students of European security, EU politics, defence studies and International Relations.

Download or read book Automating Crime Prevention Surveillance and Military Operations written by Aleš Završnik and published by Springer Nature. This book was released on 2021-08-19 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: This interdisciplinary volume critically explores how the ever-increasing use of automated systems is changing policing, criminal justice systems, and military operations at the national and international level. The book examines the ways in which automated systems are beneficial to society, while addressing the risks they represent for human rights. This book starts with a historical overview of how different types of knowledge have transformed crime control and the security domain, comparing those epistemological shifts with the current shift caused by knowledge produced with high-tech information technology tools such as big data analytics, machine learning, and artificial intelligence. The first part explores the use of automated systems, such as predictive policing and platform policing, in law enforcement. The second part analyzes the use of automated systems, such as algorithms used in sentencing and parole decisions, in courts of law. The third part examines the use and misuse of automated systems for surveillance and social control. The fourth part discusses the use of lethal (semi)autonomous weapons systems in armed conflicts. An essential read for researchers, politicians, and advocates interested in the use and potential misuse of automated systems in crime control, this diverse volume draws expertise from such fields as criminology, law, sociology, philosophy, and anthropology.
