Fulfilling the clear need for a practical guide to the nuts and bolts of the law and practice on transparency in the EU's institutional system, this book is written for the practitioner and indeed any party with an interest in availing of his or her rights under EU law. Book Openness Transparency and Access to Documents and Information in the European Union

Download or read book Openness Transparency and Access to Documents and Information in the European Union written by and published by . This book was released on 2013 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Treaty of Lisbon updates the terms under which the principles of transparency and openness clarify the right of public access to documents in the European Union. This right is both a fundamental right of individuals and an institutional principle. The revision of Regulation (EC) No 1049/2001, which sets out the arrangements for this, is influenced, to a large extent, by the numerous interpretations from the Court of Justice of the European Union, particularly during the last five years. Observation of the practice followed by the EU institutions and the broad lines of the practices followed nationally indicate that EU law needs to undergo extensive revision, with the aim of both leveraging the case law experience acquired and bringing itself up to date.

Book Transparency Participation and EU Institutional Practice

Download or read book Transparency Participation and EU Institutional Practice written by Päivi Leino and published by . This book was released on 2014 with total page 26 pages. Available in PDF, EPUB and Kindle. Book excerpt: The recent years have witnessed a growing concern in the EU institutions for the ways in which openness and citizen participation are believed to distract efficient decision-making. Various examples of such attitudes can be easily identified, demonstrating how the EU institutions still fail to possess a deeper understanding of the role of transparency in legitimate governance. This paper discusses the ways in which the right of public access often turns into institutional politics with the institutions and the Member States in fact buttressing their own interests. This has serious consequences for the understanding of citizens' rights to participate in democratic decision-making. These questions are examined in the areas of legislative matters and international relations. The problems identified are then placed in the context of wider administrative culture in the relevant EU institutions, reflected in their responses to the citizens' concerns. The paper concludes with a few remarks on the wishes of the European Council to create greater legitimacy for the Economic and Monetary Union, and the role of openness in that discussion.

Book The Illusion of Accountability in the European Union

Download or read book The Illusion of Accountability in the European Union written by Sverker Gustavsson and published by Routledge. This book was released on 2009-09-11 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines accountability in the EU from different perspectives and considers whether EU citizens have real opportunities for holding decision-makers accountable. This book critically analyses five arguments which claim there are sufficient means for holding decision-makers to account in the Union. The main conclusion is that the current institutional set-up and practice of decision-making in the EU is one that merely creates an illusion of accountability. Using a strict framework focusing on the difference between formal mechanisms and actual opportunities for accountability, this highly coherent volume will be of interest to students and scholars of European politics, especially those interested in the democratic foundations of the European political system. Book Research Handbook on EU Institutional Law

Download or read book Research Handbook on EU Institutional Law written by Adam Lazowski and published by Edward Elgar Publishing. This book was released on 2016-09-30 with total page 519 pages. Available in PDF, EPUB and Kindle. Book excerpt: Research Handbook on EU Institutional Law offers a critical look into the European Union: its legal foundations, competences and institutions. It provides an analysis of the EU legal system, its application at the national level and the prevalent role of the Court of Justice. Throughout the course of the Handbook the expert contributors discuss whether the European Union is well equipped for the 21st century and the numerous crises it has to handle. They revisit the call for an EU reform made in the Laeken Conclusions in 2001 to verify if its objectives have been achieved by the Treaty of Lisbon and in daily practice of the EU institutions. The book also delves into the concept of a Europe of different speeds, which - according to some - is inevitable in the EU comprising 28 Member States. Overall, the assessment of the changes introduced by the Lisbon Treaty is positive, even if there are plenty of suggestions for further reforms to re-fit the EU for purpose.

Prompted by these concerns, this paper represents a first attempt to address many of the aspects of transparency in government operations. It provides an overview of major issues in fiscal transparency and examines the IMF's role in promoting transparency in government operations.

Book Transparency and Secrecy in European Democracies

Download or read book Transparency and Secrecy in European Democracies written by Dorota Mokrosinska and published by Routledge. This book was released on 2020-11-11 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited volume offers a critical discussion of the trade-offs between transparency and secrecy in the actual political practice of democratic states in Europe. As such, it answers to a growing need to systematically analyse the problem of secrecy in governance in this political and geographical context. Focusing on topical cases and controversies in particular areas, the contributors reflect on the justification and limits of the use of secrecy in democratic governance, register the social, cultural, and historical factors that inform this process and explore the criteria used by European legislators and policy-makers, both at the national and supranational level, when balancing interests on the sides of transparency and secrecy, respectively. This book will be of key interest to scholars and students of security studies, political science, European politics/studies, law, history, political philosophy, public administration, intelligence studies, media and communication studies, and information technology sciences.

Book Democratic Decision making in the EU

Download or read book Democratic Decision making in the EU written by Anne Elizabeth Stie and published by Routledge. This book was released on 2015-03-05 with total page 251 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the democratic legitimacy of the European Union (EU) and evaluates the democratic credentials of the EU’s main decision-making procedure. It finds that though there is potential for democratic decision-making in the EU, the actual process is dominated by technocrats and secret meetings. The book assesses and discusses the conditions for democratic input in decision-making with five empirical chapters each addressing the ordinary legislative procedure from different dimensions: democratic deliberative forums, inclusion, openness, power neutralising mechanisms and decision-making capacity. The analytical framework provides for an in-depth assessment of the ordinary legislative procedure’s potential democratic qualities and examines whether it fulfils democratic criteria, how the procedure works in practice and whether it has the necessary democratic clout. The author provides both a theoretical discussion and an empirical assessment of what role the principle of democracy could play in the EU. Filling a gap in EU legislative studies and contributing to the debate on the European democratic deficit, Democratic Decision-making in the EU will be of interest to students and scholars of European Union politics, legislative studies and deliberative democracy.
