Book excerpt: This article evaluates the extent to which the establishment of the Andean Free Trade Zone (AFTZ) has led to an improvement of intra-regional trade, as promised by open regionalism, without reducing extra-regional trade. Open regionalism is a dynamic process in which economic agreements serve as intermediate steps towards integration with the world economy. The calculations of ex post income elasticities of import demand show that the establishment of the AFTZ in 1993 led to an increase in Andean Community trade, and not to a contraction of extra-regional trade. The intensity of trade index and the propensity to export intra- and extra-regionally confirm this finding. The article discusses these results in the context of the multilateral trading system and the trade relations between the Andean Community and the rest of the world.

The analysis of ex post income elasticities of import demand before (1980-1993) and after (1993-2000) the establishment of the AFTZ shows that the establishment of the AFTZ led to an increase of Andean Community trade, as the open regionalism view proposes, and not to a contraction of extra-regional trade. These results are confirmed by the intensity of trade index and the propensity to export intra- and extra-regionally.

Book excerpt: This title was first published in 2000: This work examines the hemispheric diplomacy after the Summits of the America in Miami (December 1994) and Santiago (April 1998), focusing on the strengthening of the South American position in the FTAA negotiations and the Brazilian proposal for a South American Free Trade Area (SAFTA). The book also looks at the implications of the preceding analysis for regional integration theory and international relations theory. The conclusion looks beyond "open regionalism" and considers three scenarios for US-South American relations after the Santiago Summit. First reassertion of US hegemony and signing of an FTAA agreement on schedule, second, erosion of US hegemony but continuing negotiations between North and South America for a "distant" FTAA, and finally, breakdown of the FTAA negotations and emergence of SAFTA as an alternative to the FTAA.

A stellar group of scholars investigate the challenges that international courts face in transforming the formal legal authority conferred by states into an actual authority in fact that is respected by potential litigants, national actors, legal communities, and publics. Alter, Helfer, and Madsen provide a novel framework for conceptualizing international court authority that focuses on the reactions and practices of these key audiences. Eighteen scholars from the disciplines of law, political science and sociology apply this framework to study thirteen international courts operating in Africa, Latin America, and Europe, as well as on a global level. Together the contributors document and explore important and interesting variations in whether the audiences that interact with international courts around the world embrace or reject the rulings of these judicial institutions. Alter, Helfer, and Madsen's authority framework recognizes that international judges can and often do everything they 'should' do to ensure that their rulings possess the gravitas and stature that national courts enjoy. Yet even when imbued with these characteristics, the parties to the dispute, potential future litigants, and the broader set of actors that monitor and respond to the court's activities may fail to acknowledge the rulings as binding or take meaningful steps to modify their behaviour in response to them. For both specific judicial institutions, and more generally, the book documents and explains why most international courts possess de facto authority that is partial, variable, and highly dependent on a range of different audiences and contexts - and thus is highly fragile. An introduction situates the book's unique approach to conceptualizing international court authority within theoretical debates about the authority of global institutions. International Court Authority also includes critical reflections on the authority framework from legal theorists, international relations scholars, a philosopher, and an anthropologist. The book's conclusion questions a number of widely shared assumptions about how social and political contexts facilitate or undermine international courts in developing de facto authority and political power.
