Book The Internationalisation of Copyright Law

Download or read book The Internationalisation of Copyright Law written by Catherine Seville and published by Cambridge University Press. This book was released on 2006-11-23 with total page 20 pages. Available in PDF, EPUB and Kindle. Book excerpt: Technological developments have shaped copyright law's development, and now the prospect of endless, effortless digital copying poses a significant challenge to modern copyright law. Many complain that copyright protection has burgeoned wildly, far beyond its original boundaries. Some have questioned whether copyright can survive the digital age. From a historical perspective, however, many of these 'new' challenges are simply fresh presentations of familiar dilemmas. This book explores the history of international copyright law, and looks at how this history is relevant today. It focuses on international copyright during the nineteenth century, as it affected Europe, the British colonies (particularly Canada), America, and the UK. As we consider the reform of modern copyright law, nineteenth-century experiences offer highly relevant empirical evidence. Copyright law has proved itself robust and flexible over several centuries. If directed with vision, Seville argues, it can negotiate cyberspace.

Book Copyright and the Challenge of the New

Download or read book Copyright and the Challenge of the New written by Brad Sherman and published by Kluwer Law International B.V.. This book was released on 2012-08-01 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Copyright is not, as is often thought, something that is periodically ‘extended’ to cover a new field or medium; rather, copyright redefines itself whenever its efficacy is challenged. While many factors have contributed to this process, the most consistent has been the challenges created by new technologies. The contributing authors build upon this insight to show that copyright law is, and has always been, a creature of technology. Each chapter focuses on a specific technology or group of technologies – photography, telegraphy, the phonogram, radio, film, the photocopier, the tape player, television, and computer programs – emphasizing the changes that each technology instigated and the challenges and opportunities it created. Perhaps the most profound insight of this extraordinary book is the authors’ claim – ably supported in a series of intriguing chapters – that the way the law responds and reacts to new technologies is always mediated by the political, social, economic, and cultural environment in which the interaction occurs. For example, these chapters describe and explain how: statutory schemes of remuneration arose from failures to effectively police new forms of piracy; persistent litigation and lobbying by copyright owners forces legislatures and courts to devise new laws; content (e.g., sporting events) generates new rules of access to broadcasts; and ‘fair copying’ (e.g., by libraries) is the necessary exception that proves the rule. As well as providing insight into the ways that copyright law interacted with old technologies when they were new, the book also offers important insights into problems and issues currently confronting copyright law and policy such as the appropriate scope of copyright and the relation between copyright and the public interest. With the broad perspectives opened by these essays, academics, practitioners and policymakers in the field will find themselves well equipped to deal with the problems that will inevitably be created by technologies in the future.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides an overview of various ways in which the spheres of art and copyright law come into contact with one another. While copyright laws are domestic in nature, the arts are increasingly international in scope, inspiration, and dissemination. The book highlights some of the challenges inherent in this overlap, ranging from definitional discrepancies between disciplines to circumstances that would benefit from more legal clarity - domestic or otherwise - to provide appropriate guidance to creators and to the organizations that display, sell, or otherwise use their artworks. The book confronts the challenges that are raised today, not only by digitization, but by new media of expression. As international art fairs proliferate, and as artists of all disciplines inspire and build from each other's works and ideas, the role of copyright in an artist's life can only become more important. Artists' Rights introduces artists to legal concepts in the intellectual property space that could become important tools in managing their artworks, now and into the future. [Subject: Art Law, Copyright Law, Intellectual Property Law]

Book Radically Rethinking Copyright in the Arts

Download or read book Radically Rethinking Copyright in the Arts written by James O. Young and published by Routledge. This book was released on 2020-06-11 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book radically rethinks the philosophical basis of copyright in the arts. The author reflects on the ontology of art to argue that current copyright laws cannot be justified. The book begins by identifying two problems that result from current copyright laws: (1) creativity is restricted and (2) they primarily serve the interests of large corporations over those of the artists and general public. Against this background, the author presents an account of the ontology of artworks and explains what metaphysics can tell us about ownership in the arts. Next, he makes a moral argument that copyright terms should be shorter and that corporations should not own copyrights. The remaining chapters tackle questions regarding the appropriation of tokens of artworks, pattern types, and artistic elements. The result is a sweeping reinterpretation of copyright in the arts that rests on sound ontological and moral foundations. Radically Rethinking Copyright in the Arts will be of interest to scholars and advanced students working in aesthetics and philosophy of art, metaphysics, philosophy of law, and intellectual property law.
