A detailed analysis of part-time work regulation is presented for seven European countries, in order to ascertain how internal domestic choices of the legislatures have merged into the 'Open method of co-ordination'. The impact of European employment policies is considered in parallel with the implementation of the Directive on part-time work, thus providing a complete overview of both soft and hard law mechanisms available to national policy-makers. In this 2004 work, the interaction between law and policy emerges as a dynamic and constantly changing process of exchange between national and supranational actors, through the use of concrete examples of lawmaking. Labour law is put forward as being central in the current evolution of European law, and this centrality is presented as a confirmation of innovation and continuity in regulatory techniques.

Book excerpt: This report is based on the analysis by the European Commission of the reports of Member States on the implementation of their 1998 National Action Plans (NAP) for employment and, on an examination of how the NAPs have been revised in line with the 1999 Employment Guidelines. The aim is to assess compliance by the Member States with the Employment Guidelines, and to evaluate policy effort and impact on the labour market. Part 1 of the report gives a comparative overview and highlights some examples of good practice. Part 2 describes the employment challenges facing the Member States. Some of the key messages of this report are: the employment performance of the EU as a whole is improving but progress varies across individual Member States; major structural challenges persist in the Member States' labour market; more preventive and active strategies are being adopted; tax and benefit systems are being reviewed but progress is slow. Other conclusions address issues such as lifelong learning, entrepreneurship, gender equality and the crucial role of the partnership approach.

Recipients of social benefits are now generally required to participate in employment activation shemes. Many are also likely to need support from health, education, housing or other services. It is widely acknowledged that there is a great need for better coordination of welfare and employment policies at all levels: local, regional and national. This report presents an analysis of initiatives in all 15 EU Member States that aim to achieve better coordination of employment activation measures. It describes the role of the different agencies and actors involved in the planning, implementation and delivery of services. It shows the approach taken in some countries and localities towards better coordination through a range of new institutions and mechanisms. The report identifies measures in both policy and practice for improving coordination, including strategic as well as operational measures, and underlines the effectiveness of a comprehensive evaluation strategy.

Book excerpt: It has become apparent that a clear gap exists between European Union (EU) level policymaking and Member State implementation. Previous research has neglected to fully define factors that encourage or prevent implementation processes and instead focused on upstream decision making processes or downstream effects of policy. Simona Milio here proposes a shift in analytical focus towards policy-implementation since this constitutes a crucial common pathway that determines whether a policy actually becomes effective or not. EU implementation deficits appear to be influenced by problems related to the multi-level structure of European policy making. Successful implementation will only occur if relevant policy actors at national and sub-national levels are persuaded to co-operate with EU policy goals. Furthermore, this co-operation is not possible unless all parties manage the complex policy networks and implementation regimes responsible for putting European policies into force. Within this framework, this book answers three important questions: 1 Is the EU multi-level governance system weakening the implementation of policies? 2 Are national and sub-national governments capable of dealing with the challenges imposed by multi-level governance? 3 Which factors account for differences in implementation performance among Member States? In order to answer these questions, Simona Milio's research explores the influence of two variables on implementation processes: Administrative Capacity and Political Stability. Cohesion Policy is chosen as the focus of this study since it has demonstrated a dramatically different implementation pace among EU Member States over the past 20 years. Three EU Member States are chosen to test the hypothesis. Italy appears to be a pertinent example, given its constant struggle to conform to EU directives and to implement Cohesion Policy. Spain is chosen since, in contrast to the Italian scenario, it represents the best performing Member State in terms of implementation. Finally Poland is studied, as a case where a shift from centralization towards decentralization has occurred in order to implement Cohesion Policy and integrate the multi-level governance system.
