Book excerpt: The purpose of this book is to discuss the relationship between information and distribution, with special reference to the role of the merchant in a market economy under conditions of risk and uncertainty. By working with simple models of the market economy and conducting a sequence of comparative analyses, the authors shed new light on an important yet rather neglected area in economics. In a historical perspective, the merchants of Ohmi, the former name of Shiga Prefecture in western Japan, are known to have put great faith in the principles of Sampo Yoshi or the all-around advantages of trading. It is hoped that the results presented in this book will provide some solid ground for such an old principle that can be seen in a new light. Applications to regional and many related problems are also discussed here. A distribution system is broadly defined as the systematic mechanisms and structures that regulate business operations, and its function is to maximize corporate value. Some of the following functions have previously been identified as distinguishing features of the Japanese distribution system compared with distribution systems in Europe and the United States: not only transactions, transportation, and storage, but also information, risk-bearing functions, and other characteristics. This book provides an overview of the distribution system in Japan, including changes that its practice have undergone and its current state; identifies current problems; and considers how these problems should be addressed.

This book is the first to compare the costs and outcomes of these approaches by examining realworld applications. In a unique format, paired case studies from the United States and Europe contrast direct regulation on one side of the Atlantic with an incentivebased policy on the other. For example, Germany‘s direct regulation of SO2 emissions is compared with an incentive approach in the U.S. Direct regulation of water pollution via the U.S. Clean Water Act is contrasted with Hollands incentive-based fee system. Additional studies contrast solutions for eliminating leaded gasoline and reducing nitrogen oxide emissions, CFCs, and chlorinated solvents. In practice, environmental policy is often a mix of both types of instruments. Even more than in the first volume the essays demonstrate the broad scope of industrial organization analysis. Besides the traditional topics such as economies of scale, monopoly and competition policy, there are essays on methodology, on stagflation, and on the relationship between industrial struc ture and international trade and trade policies. The latter topics are of growing importance. The issue of restructuring industries and the question of whether free trade or some measure of protection is more appropriate are topics of increasing relevance today (and will no doubt continue to be in future years as well). The problem of persistent inflation which other essays address is also of major concern. Apart from being broad in scope and venturing into new fields, this volume is also controversial. One of the participants in the Nijenrode conference, Professor John Blair, who died in December 1976 and whom we honour as having been an active promoter of this kind of meeting, wrote to the editors shortly before his death to say that the first volume had succeeded very well in acquainting the reader with the results of empirical investigations, notably on trends and levels of concentration.

Yet there is far less consensus than meets the eye on what constitutes price fixing, and prevalent understandings conflict with the teachings of oligopoly theory that supposedly underlie modern competition policy. Competition Policy and Price Fixing provides the needed analytical foundation. It offers a fresh, in-depth exploration of competition law's horizontal agreement requirement, presents a systematic analysis of how best to address the problem of coordinated oligopolistic price elevation, and compares the resulting direct approach to the orthodox prohibition. In doing so, Louis Kaplow elaborates the relevant benefits and costs of potential solutions, investigates how coordinated price elevation is best detected in light of the error costs associated with different types of proof, and examines appropriate sanctions. Existing literature devotes remarkably little attention to these key subjects and instead concerns itself with limiting penalties to certain sorts of interfirm communications. Challenging conventional wisdom, Kaplow shows how this circumscribed view is less well grounded in the statutes, principles, and precedents of competition law than is a more direct, functional proscription. More important, by comparison to the communications-based prohibition, he explains how the direct approach targets situations that involve both greater social harm and less risk of chilling desirable behavior--and is also easier to apply.
