Book excerpt: In Dec., 2007, during the course of an unrelated investigation being conducted by this office, we discovered a flyer at the Columbus State Community College Web site announcing auditions for an upcoming theatrical production of "A raisin in the sun." One of the contact persons on the flyer for these auditions was James Mathis, an employee at the Bureau of Workers' Compensation ("BWC"). Mathis' state telephone number and e-mail address were listed as contact information for anyone interested in auditioning for the production. We contacted BWC's Human Resources Department and Special Investigations Department for their assistance in retrieving records and other data on Mathis. A preliminary review of these records showed that a large volume of Mathis' e-mail traffic involved non-work related activities. We also found that Mathis had been involved in several musical and theatrical productions and had coordinated portions of these while on state time. We further learned that he had been compensated for his work on these productions.

Wersell also reported that Snyder may not have been performing on-site audits as required.

Book excerpt: On May 5, 2010, the Office of Inspector General initiated an investigation after being notified of an allegation concerning Ohio Bureau of Workers' Compensation Staff Attorney Julia Collier. The allegation was that Collier directed a subordinate to create a new injury claim for an injured worker after an Industrial Commission of Ohio hearing officer had ruled in April 2010 that a recent injury was an aggravation of an allowed, or approved, 2004 claim. Collier also directed a subordinate to file an appeal of the hearing officer's order using the new claim as the basis of the appeal. The new injury claim was manufactured at the direction of Collier, without the knowledge and consent of the injured worker, and for the purpose of Collier gaining an advantage during her appeal of the hearing officer's decision. The injured worker, upon being notified of the new claim, objected to the filing.

Book excerpt: On June 27, 2017, the Ohio Bureau of Workers' Compensation (OBWC) reported to the Office of the Ohio Inspector General that OBWC Public Employment Risk Reduction Program (PERRP) Director Glenn McGinley had issued a written reprimand to OBWC Industrial Safety Hygienist 4 Maria Rupert for exercising "poor judgement - secured evidence herself from a fatality scene." OBWC explained that Rupert had allegedly improperly collected a safety vest as evidence from a fatality scene and later discarded it. The investigation involved an incident which occurred on May 11, 2015, in which a Suffield Township worker was struck and killed while sealing cracks in the roadway. The public worker had been wearing a safety vest, and Rupert was assigned to investigate the incident. On July 20, 2017, the Office of the Ohio Inspector General opened an investigation to review the policies and procedures followed by PERRP personnel throughout the case, including the collection and securing of evidence and the documentation of these actions in the case file and investigative report.

Book excerpt: On May 9, 2017, the Office of the Ohio Inspector General received a referral from the Ohio Bureau of Workers' Compensation (OBWC) alleging that OBWC Accounts Receivable Manager Michelle Wedemeyer had failed to comply with OBWC policy. OBWC indicated that Wedemeyer was directed to ensure that employer refunds of account credit balances were issued prior to the implementation of a new computer system, PowerSuite, on November 14, 2016. During a review of the employer refund process, the OBWC Internal Audit Division noted that Wedemeyer had split employer credit balance refunds into two separate amounts and issued two separate payments to avoid having to obtain approval from the OBWC chief of Fiscal and Planning.

Book excerpt: On December 9, 2014, the Ohio Bureau of Workers' Compensation (OBWC) contacted the Office of the Ohio Inspector General alleging Cincinnati-Governor's Hill Service Office (CGHSO) Exam Scheduler Nina Parm had accessed a family member's claim. On November 20, 2014, OBWC Information Supervisor Jill Hollin notified a labor relations officer by email, asserting that Parm had contacted a coworker and stated that the injured worker was Parm's cousin. Hollin also stated that Parm did not realize the injured worker was her cousin until she reviewed the injured worker's previous address. Once Parm realized that the injured worker might be her cousin, Hollin stated that Parm informed her co-worker that the claim should be reassigned to the Lima Service Office. OBWC provided a Confidential Personal Information (CPI) access log for the claim files in question identifying Parm had accessed the injured worker's claim file using the OBWC internal claim management system, V3, 11 times between August 26, 2014, and November 19, 2014.

Wersell reported that Claborn accessed confidential information systems for personal use. He also advised that Claborn had been overheard telling coworkers that she had a friend at the Ohio Department of Public Safety "look up" vehicle registration information on her behalf for reasons unrelated to state business. Wersell stated Claborn had been issued a written reprimand in 2004 for violating work rules by conducting credit checks on her relatives.

Book excerpt: In December 2008, the Ohio Inspector General's Office initiated an investigation to determine what, if any, corrective measures had been taken by the Ohio Bureau of Workers' Compensation ("BWC") as a result of their own May 2007 Internal Audit report which outlined various internal control weaknesses on the part of BWC management and its Pharmacy Benefit Manager vendor, ACS State Healthcare, LLC. After conducting a preliminary investigation, we learned that BWC had taken action to remedy most of the critical issues outlined in the report. However, we identified two areas of concern relating to the management of BWC's Pharmacy benefit program that warranted further investigation: BWC's failure to pursue available drug manufacturer rebates, and the agency's delay in terminating payments for three costly medications.
