Book excerpt: First published in 1976, The Search for Security in the Pacific 1901-1914 is the first volume in a pioneering two-volume history of Australia's relations with the world, from the founding of the Commonwealth to the Great War and its immediate aftermath. This book is based on wide-ranging research in collections of personal and official papers in Australia, Britain, the United States and Canada and offers original insights into Australia's political culture. In taking the story up to the outbreak of the European conflict it shows the great impact that the looming presence of East Asia had on Australia's perception of the world and on the evolution of a distinctive defence and foreign policy. It tells the story of how in an age of race nationalism the fear of Asia led first to the making of the Commonwealth and the White Australia policy and then after Japan's defeat of Russia in 1905 to the potential prospect of a military invasion from the north. This sense of an 'Australian Crisis' pervaded the whole society and found expression in poetry, plays, novels, cartoons, at least one film, newspaper editorials as well as political speeches. To meet this threat Australian leaders, against all the advice from the British authorities, introduced compulsory military training and established a navy and a fledgling air force. The outbreak of the European war found the Australians resentful about the British betrayal and anxious to know what the Empire's involvement in that conflict might mean for the Pacific. This divergence of security concerns created tension between Australia's community of culture and its community of interest, between its British identity and its geopolitical circumstances.

More than 50,000 treaties have been concluded since the United Nations began, and Australia is now a party to over 900 conventions and treaties. International law affects our understanding of human rights, criminal law, the environment, international trade, intellectual property and industrial relations. Over the past forty years many nations have recognised their growing interdependence, as international law has become more involved in their structures and workings. The old focus upon external relations between nations has broadened to include events within nations. International bodies, such as the UN Human Rights Committee, now scrutinise the conformity of Australian law with international norms. Australian courts have consequently given greater recognition to international law, even in cases where Australia has not yet implemented the relevant treaty in domestic law. Federal Parliament is now able to use international treaties as a basis for domestic law, and this has dramatically affected the traditional division of legislative authority between state and federal spaces. And yet the role of government lawyers in Australia, and specifically the Solicitor-General as the most senior of government lawyers, is under-theorised and under-studied. The Role of the Solicitor-General: Negotiating Law, Politics and the Public Interest goes behind the scenes of government – drawing from interviews with over 45 government and judicial officials – to uncover the history, theory and practice of the Australian Solicitor-General. The analysis reveals a role that is of fundamental constitutional importance to ensuring both the legality and the integrity of government action, thus contributing to the achievement of rule-of-law ideals. The Solicitor-General also works to defend government action and prosecute government policies in the court, and thus performs an important role as messenger between the political and judicial branches of government. But the Solicitor-General's position, as both an internal integrity check on government and an external warrior for government, gives rise to competing pressures: between the law, politics and the public interest. The office of the Solicitor-General in Australia has evolved many characteristics across the almost two centuries of its history in an attempt to navigate these tensions. These pressures are not unique to the Australian context.
