  • Author : Neil Gunningham
  • Publisher : Federation Press
  • Release : 2007
  • ISBN : 9781862875661
  • Pages : 308 pages

Download or read book Mine Safety written by Neil Gunningham and published by Federation Press. This book was released on 2007 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: Historically, the mining industry has had a high incidence of work related injury and disease, and of disasters involving multiple fatalities. It also faces OHS challenges far exceeding those confronting most other industry sectors.Mine safety legislation can play an important role in meeting those challenges. Although regulation is never likely to be the entire answer, good regulation not only brings laggards up to a minimum legal standard, it also encourages, rewards and facilitates leaders in going beyond them. Bad regulation, in contrast, constrains good enterprises from taking the initiative to improve OHS, while failing to deter bad ones. This book describes mine safety legislation in the "mining states" and analyses its strengths and weaknesses. It also examines the broader policy questions of how best to design, implement and enforce mine safety regulation. It argues that substantial reform will be necessary not only in setting standards, but also in their implementation, if further OHS improvements are to be achieved. This implies substantial changes in the way the mine safety inspectorates go about their tasks: in how they administer and enforce the law; and in the circumstances in which they choose to prosecute. It also requires the nurturing of a degree of trust between employers and workers (individually and collectively) and between both these parties and the mines inspectorates, that has been substantially lacking in recent years.

Book Migrant Rights at Work

    Book Details:
  • Author : Laurie Berg
  • Publisher : Routledge
  • Release : 2015-06-26
  • ISBN : 1317617819
  • Pages : 342 pages

Download or read book Migrant Rights at Work written by Laurie Berg and published by Routledge. This book was released on 2015-06-26 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public debates about the terms of membership and inclusion have intensified as developed economies increasingly rely on temporary migrant labour. While most agree that temporary migrant workers are entitled to the general protection of employment laws, temporary migrants have, by definition, restricted rights to residence, full social protections and often to occupational and geographic mobility. This book raises important ethical questions about the differential treatment of temporary and unauthorised migrant workers, and permanent residents, and where the line should be drawn between exploitation and legitimate employment. Taking the regulatory reforms of Australia as a key case study, Laurie Berg explores how the influence of immigration law extends beyond its functions in regulating admission to and exclusion from a country. Berg examines the ways in which immigration law and enforcement reconfigure the relationships between migrant workers and employers, producing uncertain and coercive working conditions. In presenting an analytical approach to issues of temporary labour migration, the book develops a unique theoretical framework, contending that the concept of precariousness is a more fruitful way than equality or vulnerability to evaluate and address issues of temporary migrant labour. The book will be of great interest to scholars and practitioners of immigration law and employment law and policy.

Book The Legal Rights of Students with Disabilities

Download or read book The Legal Rights of Students with Disabilities written by Charles J. Russo and published by Rowman & Littlefield Publishers. This book was released on 2011-06-16 with total page 267 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since 1948 when the United Nations adopted the Universal Declaration of Human Rights, all students have been declared the right to education. The rights of disabled students have not been explicitly addressed, however, and each country has developed their own rules and regulations. Although similarities exist among the different countries, differences are evident, especially in both the extent and acknowledgment of these rights. The Legal Rights of Students with Disabilities: International Perspectives examines the rights of disabled students in ten diverse countries on six continents. Written by leading experts in education law, this volume provides comparative insights to help meet the educational needs of disabled students. The book also offers strategies to manage the legal and educational complexities associated with special education.

Book Energy Law and the Environment

Download or read book Energy Law and the Environment written by Patricia Park and published by CRC Press. This book was released on 2002-02-07 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: The area of law concerning energy and the environment is a dynamic one. Decisions are constantly being made at all levels, from international summits to local courts of law, which then filter down and affect law-makers, law students and ultimately members of the public. Energy Law and the Environment is the first book to consider the interrelationship between energy law and the legal environmental imperatives for the industrial sector including current issues and future developments. This is not a book solely for academics - it has been written to be accessible to both lawyers and non-lawyers alike. The importance of the subject matter and its place in the context of the sustainable development of the energy sector, which underpins all economic development, should make it essential reading for both those working in the energy sectors and those concerned with the effects that the sector has on the global environment. It can also be used as a text for courses at undergraduate and graduate level on both energy law and environmental law.
