Book Occupational Safety and Health Law Handbook

Download or read book Occupational Safety and Health Law Handbook written by John D. Surma and published by Bernan Press. This book was released on 2023-11-30 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: Now in its fourth edition, the popular Occupational Safety and Health Law Handbook has been your go-to guide to the fundamentals of occupational safety and health law for over a decade. It provides an authoritative and completely up-to-date reference that you count on for its reliable information and straightforward explanation. Each chapter is written by a highly respected attorney who is an expert in the field. Yet the book is written without legal jargon, in plain English that anyone can understand. In it, the authors provide interpretations of many facets of the Occupational Safety and Health Act, review regulations and standards governing employee protection, and offer advice for dealing with regulatory authorities. The Handbook covers all of the important legal aspects of the Occupational Safety and Health Act with clearly written explanations of such issues as the boundaries of OSHA regulations, general administrative law concepts, and OSHA's enforcement tactics. As in the previous edition, this edition begins with an overview of the OSH Act in Chapter 1 and then addresses who is covered under the OSH Act, the development of safety and health laws, and the employer’s duty to comply with occupational safety and health laws in Chapters 2 through 4. Chapter 5 provides a detailed discussion of the recording and reporting rules for work-related injuries and illness as well other recordkeeping requirements under specific safety and health standards. Chapters 6 and 7 focus on the rights of employers and employees, including employees’ right against unlawful discrimination related to protected safety activity. In Chapter 8, the authors provide a detailed discussion of the new hazard communication provisions that conform with the Globally Harmonized System. Chapter 9 covers the use of voluntary safety and health self-audits that employers may use to identify and correct safety and health hazards. Chapters 10 and 11 discuss OSHA’s primary enforcement tools — inspections and investigations and citations issued following an inspection or investigation. These chapters also contain insight on steps employers may need to take during an inspection or investigation. Chapter 12 explains the procedures for challenging a citation before the Occupational Safety and Health Review Commission and federal court of appeals. Chapter 13 covers criminal enforcement of OSHA standards. The last chapter covers imminent domain inspections. The Occupational Safety and Health Law Handbook serves as a useful guide for practitioners in the occupational safety and health field who are responsible for addressing safety and health concerns in the workplace.

Download or read book Streamlining of Provisions on State Plans for Occupational Safety and Health Us Occupational Safety and Health Administration Regulation Osha 2018 Edition written by The Law Library and published by Independently Published. This book was released on 2018-12-07 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law Library presents the complete text of the Streamlining of Provisions on State Plans for Occupational Safety and Health (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition). Updated as of May 29, 2018 This document primarily amends OSHA regulations to remove the detailed descriptions of State plan coverage, purely historical data, and other unnecessarily codified information. In addition, this document moves most of the general provisions of subpart A of part 1952 into part 1902, where the general regulations on State plan criteria are found. It also amends several other OSHA regulations to delete references to part 1952, which will no longer apply. The purpose of these revisions is to eliminate the unnecessary codification of material in the Code of Federal Regulations and thus save the time and funds currently expended in publicizing State plan revisions. The streamlining of OSHA State plan regulations does not change the areas of coverage or any other substantive components of any State plan. It also does not affect the rights and responsibilities of the State plans, or any employers or employees, except to eliminate the burden on State plan designees to keep paper copies of approved State plans and plan supplements in an office, and to submit multiple copies of proposed State plan documents to OSHA. This document also contains a request for comments for an Information Collection Request (ICR) under the Paperwork Reduction Act of 1995 (PRA), which covers all collection of information requirements in OSHA State plan regulations. This ebook contains: - The complete text of the Streamlining of Provisions on State Plans for Occupational Safety and Health (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure

Book A Smarter National Surveillance System for Occupational Safety and Health in the 21st Century

Download or read book A Smarter National Surveillance System for Occupational Safety and Health in the 21st Century written by National Academies of Sciences, Engineering, and Medicine and published by National Academies Press. This book was released on 2018-04-27 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: The workplace is where 156 million working adults in the United States spend many waking hours, and it has a profound influence on health and well-being. Although some occupations and work-related activities are more hazardous than others and face higher rates of injuries, illness, disease, and fatalities, workers in all occupations face some form of work-related safety and health concerns. Understanding those risks to prevent injury, illness, or even fatal incidents is an important function of society. Occupational safety and health (OSH) surveillance provides the data and analyses needed to understand the relationships between work and injuries and illnesses in order to improve worker safety and health and prevent work-related injuries and illnesses. Information about the circumstances in which workers are injured or made ill on the job and how these patterns change over time is essential to develop effective prevention programs and target future research. The nation needs a robust OSH surveillance system to provide this critical information for informing policy development, guiding educational and regulatory activities, developing safer technologies, and enabling research and prevention strategies that serves and protects all workers. A Smarter National Surveillance System for Occupational Safety and Health in the 21st Century provides a comprehensive assessment of the state of OSH surveillance. This report is intended to be useful to federal and state agencies that have an interest in occupational safety and health, but may also be of interest broadly to employers, labor unions and other worker advocacy organizations, the workers' compensation insurance industry, as well as state epidemiologists, academic researchers, and the broader public health community. The recommendations address the strengths and weaknesses of the envisioned system relative to the status quo and both short- and long-term actions and strategies needed to bring about a progressive evolution of the current system.

Book The Regulation and Management of Workplace Health and Safety

Download or read book The Regulation and Management of Workplace Health and Safety written by Peter Sheldon and published by Routledge. This book was released on 2020-07-12 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book provides a collection of cutting-edge, multi-disciplinary research-based chapters on work, workers and the regulation and management of workplace health and safety. Featuring research from Australia, Europe and North America, the chapters traverse important historical examples and place important, emerging contemporary trends, like work in the gig economy, into wider international and historical perspectives. The authors are leading authorities in their fields. The book contributes to advancing our knowledge – empirical and theoretical – of the ways in which labour market dynamics, management strategies, state regulation and public policy, and union organisation affect outcomes for workers. It features in-depth exploration of, and reflection on, some of the major labour market challenges facing workers, and analysis of strengths and weaknesses of responses to those challenges, whether via management, state regulation or collective employee voice. The chapters highlight shifts in in/equality of outcomes; access to security and flexibility at work; genuine access to workplace voice and decision-making; and the implications of different avenues and mechanisms for regulating work and employment. The text is aimed at researchers, undergraduate and postgraduate students in work and organisational studies, industrial/employment relations and human resource management, workplace (or occupational) health and safety, employment law, and labour history. It will also be of particular interest to policy makers and practitioners working in the field of workplace health and safety.
