J'ai souvent aussi éclairci le texte par des exe ples; mais je me suis particulièrement attaché à fondre dans mes explications -la doctrine de la cour suprême, sur les nombreuses questions qui se sont agitées devant elle. C'est en effet, dans lajurisprudence de cette cour que se trouve souvent la plus saine comme la plus claire explication: de, la loi;.car l'o'n conçoit que l'importance des affaires criminelles et les faci lités données aux condamnés pour se pourvoir en cassation, aient dû mettre cette cour à portée d'examiner toutes les difficultés que chaque ar ticle de nos Codes*d'instruction et pénal peut présenter; aussi est - cc dans la jurisprudence de cette cour que tous les commentateurs ont puisé la plupart de leurs observations; Je ne devais pas plus qu eux négliger cette source féconde; mais en dégageant chaque question de la narration des faits inutile dans un ouvrage élémentaire et en analysant avec soin les mo tifs des arrêts il m'a été possible de présenter exactement l'état de notre jurisprudence crimi nelle, sans dépasser les limites que je me suis prescrites pour que mon ouvrage restât élémen taire et usuel. De cette manière, et quelque fidèle que soit dans mon travail ce résumé de la jurisprudence j'ai pu, le premier, réunir le Code d'instruction et le Code pénal dans un seul volume it: - 18, avec toutes les explications nécessaires à leur parfaite intelligence. J'ai pensé qu'il serait commode d'avoir sans cesse sous la main et de pouvoir emporter à l'audience' deux ouvrages qui ont tant de rapports et qui s'ex pliquent souvent mutuellement, comme aussi de pouvoir, à l'instant même et sans aucune recherche, connaître la jurisprudence de la cour suprême, sur une difficulté qui s'élève tout à coup. Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
