Book A Trial by Jury

Download or read book A Trial by Jury written by D. Graham Burnett and published by Vintage. This book was released on 2002-10-15 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: When Princeton historian D. Graham Burnett answered his jury duty summons, he expected to spend a few days catching up on his reading in the court waiting room. Instead, he finds himself thrust into a high-pressure role as the jury foreman in a Manhattan trial. There he comes face to face with a stunning act of violence, a maze of conflicting evidence, and a parade of bizarre witnesses. But it is later, behind the closed door of the jury room, that he encounters the essence of the jury experience — he and eleven citizens from radically different backgrounds must hammer consensus out of confusion and strong disagreement. By the time he hands over the jury’s verdict, Burnett has undergone real transformation, not just in his attitude toward the legal system, but in his understanding of himself and his peers. Offering a compelling courtroom drama and an intimate and sometimes humorous portrait of a fractious jury, A Trial by Jury is also a finely nuanced examination of law and justice, personal responsibility and civic duty, and the dynamics of power and authority between twelve equal people.

Available in PDF, EPUB and Kindle. Book excerpt: Origins of the English Jury. Originally published: Jersey City: Frederick D. Linn, [1875]. x, 388 pp. First published in England in 1852, Forsyth's History of Trial by Jury is the first full-scale historical account of the rise and growth of the jury system in England. Highly regarded, this book went through 37 editions. The first American edition, the source of this reprint, adds a number of notes and corrections to American references in previous editions. "An excellent summary of the opinions of leading legal writers as well as conventional historians regarding the origins of trial by jury was set forth by an Englishman, William Forsyth, in his excellent book entitled History of Trial by Jury. (. . .) Various writers, according to Forsyth, attribute the origin of the English jury to a recognition of the principle that no man ought to be condemned except by the voice of his fellow citizens. Forsyth committed himself to the belief that trial by jury did not owe its existence to any positive law, that it was not created by any Act of Parliament, but grew out of usages and customs of society that eventually passed away. Forsyth concluded his observations by saying that "the jury does not owe its existence to any preconceived theory of jurisprudence, but that it gradually grew out of forms previously in use and was composed of elements long familiar to the people in general." -- Robert H. White, 29 Tennessee Law Review 29 (1961-1962) 14 William Forsyth [1812-1899] was an English lawyer and author of many works on law and literature, including The History of Lawyers (1849).

Excerpt: ...here is, " how far the person is disqualified from being a " juryman, having been tried, convicted, and " punished on his own confession? Thisadmis" sibility depends not on the punishment, but on " the nature of the crime, and the question is, " Whether it infers infarniajuris? I have looked " at the indictment to ascertain the crime, and " it being of the nature of crimenfalsi, all the " authorities agree that irgfamiajuris follows. " The next question is, Whether this disqualifi" cation applies tojurymen? The statute I68," and others, go to establish, that infamia jurz';s " disqualifies persons from being jurymen; and " even if they did not, the analogy would go " far to establish it. A person convicted of such " a crime cannot be a witness; he has got into " such a relation to civil society, that he is not " to be believed on his oath; and that ajuryman " is on oath is too clear to require illustration. I " therefore hold him disqualified. This leads to " the question, how far the act of parties, by ac" quiescence or consent, rendered him a fit jury" man? Consent of parties can do a great deal, " but in the question as to the competency ofa " juryman, the Court must be a party as well as " the pursuer and defender. There was a case " in this Court, where a writer to the Signet was " taken as a juryman; but then the Court, as " well as the parties, consented to this, and the " disqualification was taken off. The disqualifi" cation of writers, was from a fear of perplex" ing the juries with subtilties of law; but, in " the present case, if the...
