Book excerpt: Abstract: According to Weber, law should become more rational and efficient over time. However, it is unclear whether obscenity laws have followed this trajectory. The current obscenity definition, laid down by the 1973 Miller v California case, uses three criteria for determining obscenity, one being whether or not the material violates the local community standards. Community standards may be difficult to determine, thus making the law unusually vague. Although social scientists have studied the obscenity problem from a more quantitative and macro-oriented approach, little qualitative research has been done to shed light on the actual experiences of the people most involved, the "adult" business owners. First, I examine the evolution of obscenity law over time using a historical analysis of landmark Supreme Court obscenity cases to see if obscenity law is becoming more vague or more rational. Then I conduct 15 interviews in 2 Midwest cities with "adult" business owners and others involved in the obscenity debate to examine whether those most affected by obscenity laws understand what the laws say. I contend that obscenity law is becoming more irrational due to a lack of consensus regarding local community standards in our progressively diverse society.

The Hateful and the Obscene is intended to fill that gap. L.W. Sumner brings philosophical depth and theoretical rigour to some of the most important and difficult questions concerning free expression. Building on a framework set out by J.S. Mill – that a legal restriction of expression is justified only when the expression in question is harmful to others and when the benefits of the restriction will exceed its costs – Sumner shows how the Canadian courts have replicated Mill's framework in their interpretation of the Canadian Charter of Rights and Freedoms. The Hateful and the Obscene is a compelling interpretation of freedom of expression that combines serious philosophical thought with a focus on Canadian law, thus maintaining the breadth to deal with both obscenity and hate literature.

Criminal convictions for obscenity have frequently been disputed due to the ambiguous nature contained within the three-part test, especially having the trier of fact apply "contemporary community standards." Technological advances and increasing homogeneity has added to the dubious nature of the test and some feel obscenity laws need revised, ifnot eliminated. Numerous suggestions have been made to improve the "intractable problem" ofdetennining what is obscene speech. This paper considers some of those possibilities and suggests commentary on others. One way of detennining community standards while maintaining a federalist court system is moving obscenity to the civil courts allowing individuals and communities to defme local differing standards.
