Foram desenvolvidas novas concepções como - as teorias da multifuncionalidade, da justiciabilidade e da integralidade dos direitos fundamentais (as medidas ou meios utilizados pelo processo penal lato sensu somente são justificáveis se forem considerados todos os direitos fundamentais da pessoa afetada, inclusive direitos sociais como saúde, trabalho e educação); a ponderabilidade de quaisquer objetos normativos; a exigência constitucional de justificação teleológica; os fins imediatos e mediatos da persecução criminal; a necessidade de consideração das premissas empíricas, normativas e analíticas; a controlabilidade substancial intensiva das medidas concretas de intervenção em direitos fundamentais; a contrariedade fundamental da persecução criminal; o poder geral de cautela garantista de direitos fundamentais; a alternatividade e a redutibilidade de medidas cautelares pessoais (prisão provisória, liberdade provisória, medida de segurança provisória, menagem, proibição de viagem ao exterior, exílio local do bairro ou cidade etc.).
