Available in PDF, EPUB and Kindle. Book excerpt: During the last decade Europe has undertaken an active and broad process of harmonisation of choice-of-law rules within the EU. However, this drastic movement towards a harmonised system has so far left aside a highly relevant issue: the application by judicial and non-judicial authorities of the foreign law. In full contrast to the little attention so far paid to it in the EU, this issue is said to be the crux of the conflict of laws. It violates legal certainty and contradicts the objective of ensuring full access to justice to all European citizens within the EU. This book provides a comparative study of the existing situation in all EU member states and drafts some basic principles for a future European instrument. It will become a highly useful tool for lawyers, judges, notaries, land registries, academics, prosecutors etc.

Book excerpt: •Chapter 6, concerning the impact of the Constitution, has been streamlined to enhance “teachability.” The 2016 opinion in franchise tax Board versus Hyatt is now included as a principal case. •Chapters 7 and 8 present the central themes of choice of law. Both have been updated substantially. Chapter 8 has been considerably revised to show the progression from the traditional system, to the height of the conflicts revolution, to a developing consensus to consolidate modern analysis in a manner that provides more predictability and certainty. This revision is designed to give students -- most of whom have little or no familiarity with choice of law doctrine -- a b.

Book Developments in the Private International Law Doctrine of Renvoi Since 1990

Download or read book Developments in the Private International Law Doctrine of Renvoi Since 1990 written by Andrew Brantley Lu and published by . This book was released on 2010 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: The theory of choice of law has received close attention in Australia since 1990. In 2000, the High Court of Australia chose the law of the place of the tort, without flexible exceptions, as Australia's new choice of law rule for intra-national torts. In 2002, it extended the rule to transnational torts litigated in Australia. Since 2002, problems inherent in the inflexible nature of the Australian choice of law rule have emerged. This prompted Australian courts to concede that, in the interests of justice and fairness, judicial discretion on choice of law may sometimes be appropriate. It is in this context that Australian courts have controversially revived debate on the doctrine of renvoi in the common law. Renvoi arises as an adjunct to choice of law. Australia's response to renvoi has provoked active debate among conflicts scholars internationally, because it applies renvoi to a tort case. Some of the debate has praised the Australian use of renvoi for its creativity, in other respects it has been critical of the High Court's unprincipled expansion of the doctrine contrary, firstly, to the traditional presumption against renvoi's application, and secondly, to the doctrine's contraction in other jurisdictions.

Book Trends of Private International Law

Download or read book Trends of Private International Law written by Pavel Kalenský and published by Springer Science & Business Media. This book was released on 2013-12-01 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: to Seeking the answer to the three basic questions of contempo rary private international law, I also deemed it essential to out line to the reader the historical development of the different concepts of this particular branch of law, for without the know ledge of this history it is impossible to understand the contempo rary problems. The fact that private international law oscillates between public international law and substantive municipal law as it is applied in individual countries creates considerable problems in both theory and practice. I have tried to deal with these problems in the third part of my study, concerning "universa lism" and "nationalism" in the doctrine of private international law, as well as in its fourth part, which is devoted to the object and nature of this law and its place in the overall system of law. The character of private international law, ensuing from the plurality of municipal laws - which also characterize the origin and existence of comparative jurisprudence - in spired me to produce the fifth part of this study, which prima rily tries to expJain the theoretical problems of comparative jurisprudence but does so - defining its objectives and possibili ties - in order to underline at the same time its role in private international law and in the law of international trade.
