Book excerpt: Au rang des paradoxes de notre société, figure l’aspiration quasi-insatiable des citoyens à d’avantage de liberté et donc, de solutions individualisées, alors même que les normes juridiques explosent en ordre dispersé (diminution de la qualité légistique des textes, inflation, bousculade dans la hiérarchie des normes ou des méta-normes, recul de l’étique et de la morale…) et se répandent, telle des lianes sur un arbre croissant. Dans le même contexte, le temps s’accélère. Le public, esclave de ses peurs et de ses envies, « consomme » du service juridique comme un autre produit, sans être en mesure de gérer ses frustrations et ses angois ses, et pour une frange de la population, sans être en mesure de poser une vraie réflexion. Il s’ensuit immanquablement des tensions entre différentes aspirations sociales (sécurité juridique, liberté, besoin de reconnaissance, protection du faible, protection de l’environnement, …) que certains acteurs de la société, dont les notaires, doivent gérer à leur mesure. C’est à partir de ce constat que le thème du Congrès des notaires 2011 s’est révélé : « Entre liberté et contraintes normatives, le notaire face à un défi ». Pour traiter ce thème, la commission scientifique a fait appel à une palette d’auteurs de tous horizons, rassemblés en quatre modules : « droit du couple », « droit successoral », « droit judiciaire notarial » et « droit immobilier ». À l’intérieur de chacun de ces modules, il a été demandé aux auteurs de répondre à trois questions : 1. Quels sont les sujets d’actualité qui mettent en tension la liberté contractuelle et ses limites ? 2. Quelles sont les balises pour cerner la liberté d’action des parties ? (en rappelant non seulement l’état de la jurisprudence sur ces différents sujets mais en démontrant également en quoi le droit est parfois réactionnaire) ; 3. Quel est le rôle des notaires dans ce contexte, en fonction des différentes casquettes que les officiers publics sont susceptibles d’endosser ? L’objectif de chaque module est de fournir à tous les praticiens des outils pour une meilleure compréhension du cadre sociétal dans lequel ils évoluent, pour une approche des contrats et arrangements de famille davantage en phase avec la revendication de liberté et de personnalisation exprimée par la clientèle.

Nobles and diviners, butchers and monks, concubines and physicians, blacksmiths and pregnant girls--in short, all men over fourteen and women over twelve--were summoned by Dominican inquisitors Bernart de Caux and Jean de Saint-Pierre. In the cloister of the Saint-Sernin abbey, before scribes and witnesses, they confessed whether they, or anyone else, had ever seen, heard, helped, or sought salvation through the heretics. This inquisition into heretical depravity was the single largest investigation, in the shortest time, in the entire European Middle Ages. Mark Gregory Pegg examines the sole surviving manuscript of this great inquisition with unprecedented care--often in unexpected ways--to build a richly textured understanding of social life in southern France in the early thirteenth century. He explores what the interrogations reveal about the individual and communal lives of those interrogated and how the interrogations themselves shaped villagers' perceptions of those lives. The Corruption of Angels, similar in breadth and scope to Emmanuel Le Roy Ladurie's Montaillou, is a major contribution to the field.
