Book excerpt: The Transport Bill covers the duty of the Department for Regional Development to secure the provision of public passenger transport services by road and by rail, the power to enter into service agreements and award service permits for that purpose, the ability to attach conditions to and vary a service permit. It also creates offences and provides enforcement powers in respect of the contracting / service permit regime. It provides powers to regulate fares, designate bus stations/premises as shared facilities, regulate passenger conduct in bus premises, provide for integrated and on-street ticketing systems, make grants for the provision of bus services of benefit to certain sections of the public, acquire and dispose of land, provide vehicles and facilities for public transport purposes, and to exploit commercial opportunities arising from its public transport functions. The key issues identified by the Committee included: the need for due regard to sustainability & accessibility; local transport plans; need for legal representations from community transport providers; enforcement issues; termination of permit where holder becomes a mental health patient; conviction under the National Minimum Wage Act as grounds for revocation, suspension or curtailment of permit; consultation with Consumer Council's transport forward work programme; consultation on subordinate legislation being development for shared transport facilities; the latitude provided to the Department under clause 45; the need for regulations arising from the Bill to be subject to draft affirmative procedure; the definition of authorised person; and the Review of the Outline Business Case for Public Transport Reform
