Book excerpt: Women before the Bar is the first study to investigate changing patterns of women's participation in early American courts across a broad range of legal actions--including proceedings related to debt, divorce, illicit sex, rape, and slander. Weaving the stories of individual women together with systematic analysis of gendered litigation patterns, Cornelia Dayton argues that women's relation to the courtroom scene in early New England shifted from one of integration in the mid-seventeenth century to one of marginality by the eve of the Revolution. Using the court records of New Haven, which originally had the most Puritan-dominated legal regime of all the colonies, Dayton argues that Puritanism's insistence on godly behavior and communal modes of disputing initially created unusual opportunities for women's voices to be heard within the legal system. But women's presence in the courts declined significantly over time as Puritan beliefs lost their status as the organizing principles of society, as legal practice began to adhere more closely to English patriarchal models, as the economy became commercialized, and as middle-class families developed an ethic of privacy. By demonstrating that the early eighteenth century was a crucial locus of change in law, economy, and gender ideology, Dayton's findings argue for a reconceptualization of women's status in colonial New England and for a new periodization of women's history.

Raphael Sealey analyzes the rights of women in marriage, in the control of property, and in questions of inheritance. He advances the theory that the legal disabilities of Greek women occurred because they were prohibited from bearing arms. Sealey demonstrates that, with some local differences, there was a general uniformity in the legal treatment of women in the Greek cities. For Athens, the law of the family has been preserved in some detail in the scrupulous records of speeches delivered in lawsuits. These records show that Athenian women could testify, own property, and be tried for crime, but a male guardian had to administer their property and represent them at law. Gortyn allowed relatively more independence to the female than did Athens, and in Sparta, although women were allowed to have more than one husband, the laws were similar to those of Athens. Sealey's subsequent comparison of the law of these cities with Roman law throws into relief the common concepts and aims of Greek law of the family. Originally published in 1990. Book excerpt: By the twentieth century, North Carolina’s progressive streak had strengthened, thanks in large part to a growing number of women who engaged in and influenced state and national policies and politics. These women included Gertrude Weil who fought tirelessly for the Nineteenth Amendment, which extended suffrage to women, and founded the state chapter of the League of Women Voters once the amendment was ratified in 1920. Gladys Avery Tillett, an ardent Democrat and supporter of Roosevelt's New Deal, became a major presence in her party at both the state and national levels. Guion Griffis Johnson turned to volunteer work in the postwar years, becoming one of the state's most prominent female civic leaders. Through her excellent education, keen legal mind, and family prominence, Susie Sharp in 1949 became the first woman judge in North Carolina and in 1974 the first woman in the nation to be elected and serve as chief justice of a state supreme court. Throughout her life, the Reverend Dr. Anna Pauline "Pauli" Murray charted a religious, literary, and political path to racial reconciliation on both a national stage and in North Carolina.
