Book Interpreting the Nuclear Non Proliferation Treaty

Download or read book Interpreting the Nuclear Non Proliferation Treaty written by Daniel H. Joyner and published by Oxford University Press. This book was released on 2011-05-26 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 1968 Nuclear Non-proliferation Treaty has proven the most complicated and controversial of all arms control treaties, both in principle and in practice. Statements of nuclear-weapon States from the Cold War to the present, led by the United States, show a disproportionate prioritization of the non-proliferation pillar of the Treaty, and an unwarranted underprioritization of the civilian energy development and disarmament pillars of the treaty. This book argues that the way in which nuclear-weapon States have interpreted the Treaty has laid the legal foundation for a number of policies related to trade in civilian nuclear energy technologies and nuclear weapons disarmament. These policies circumscribe the rights of non-nuclear-weapon States under Article IV of the Treaty by imposing conditions on the supply of civilian nuclear technologies. They also provide for the renewal and maintaintenance, and in some cases further development of the nuclear weapons arsenals of nuclear-weapon States. The book provides a legal analysis of this trend in treaty interpretation by nuclear-weapon States and the policies for which it has provided legal justification. It argues, through a close and systematic examination of the Treaty by reference to the rules of treaty interpretation found in the 1969 Vienna Convention on the Law of Treaties, that this disproportionate prioritization of the non-proliferation pillar of the Treaty leads to erroneous legal interpretations in light of the original balance of principles underlying the Treaty, prejudicing the legitimate legal interests of non-nuclear-weapon States.

Book The Nonproliferation Predicament

Download or read book The Nonproliferation Predicament written by Joseph F. Pilat and published by Transaction Publishers. This book was released on 1985-01-01 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Nonproliferation Predicament is an authoritative and comprehensive look at U.S. nonprolif-eration policy. Top U.S. scholars, analysts, and policymakers focus on the period since the Reagan administration took office and address several questions about the current state of nuclear proliferation: As the international non-proliferation regime evolves will it continue to be responsive to the problem of proliferation? Or will it become superannuated by new technologies, or enmeshed in domestic and international political controversies and conflicting interests? What nonproliferation policies are likely to be effective in the 1980s and beyond, as nations continue efforts to establish and expand nuclear industrial bases, providing them with capabilities useful for the pursuit of weapons options in the future? Does the stagnation of the international nuclear market and the difficulties of nuclear threshold states like India give reasons for hope? Or will the limited proliferation of the past prove to have been a passing anomaly in military history?

Download or read book Stopping the Bomb written by Nicholas L. Miller and published by Cornell University Press. This book was released on 2018-04-15 with total page 510 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is an intense and meticulously sourced study on the topic of nuclear weapons proliferation, beginning with America's introduction of the Atomic Age... His book provides a full explanation of America's policy with a time sequence necessarily focusing on the domino effect of states acquiring a nuclear weapons capability and the import of bureaucratic decisions on international political behavior.― Choice Stopping the Bomb examines the historical development and effectiveness of American efforts to prevent the spread of nuclear weapons. Nicholas L. Miller offers here a novel theory that argues changes in American nonproliferation policy are the keys to understanding the nuclear landscape from the 1960s onward. The Chinese and Indian nuclear tests in the 1960s and 1970s forced the US government, Miller contends, to pay new and considerable attention to the idea of nonproliferation and to reexamine its foreign policies. Stopping the Bomb explores the role of the United States in combating the spread of nuclear weapons, an area often ignored to date. He explains why these changes occurred and how effective US policies have been in preventing countries from seeking and acquiring nuclear weapons. Miller's findings highlight the relatively rapid move from a permissive approach toward allies acquiring nuclear weapons to a more universal nonproliferation policy no matter whether friend or foe. Four in-depth case studies of US nonproliferation policy—toward Taiwan, Pakistan, Iran, and France—elucidate how the United States can compel countries to reverse ongoing nuclear weapons programs. Miller's findings in Stopping the Bomb have important implications for the continued study of nuclear proliferation, US nonproliferation policy, and beyond.

Book International Nuclear Export Controls and Non Proliferation

Download or read book International Nuclear Export Controls and Non Proliferation written by Ian J. Stewart and published by Routledge. This book was released on 2021-09-27 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the evolution of international nuclear non-proliferation trade controls over time. The book argues that the international nuclear export controls have developed in a sub-optimal way as a result of a non-proliferation collective action problem. This has resulted in competition among suppliers, owing to the absence of an overarching effective system of control. While efforts have been undertaken to address this collective action problem and strengthen controls over time, these measures have been inherently limited, it is argued here, because of the same structural factors and vested interests that led to the creation of the problem in the first place. This study examines international controls from the beginning of the nuclear age and early efforts to control the atom, up to more recent times and the challenge posed by Iranian and North Korean nuclear ambitions. Drawing on a rich body of original archival research and interviews, the book demonstrates that the collective action problem has restrained cooperation in preventing nuclear proliferation and that gaps persist in the international nuclear trade control regime. This book will be of much interest to students of nuclear proliferation and arms control, security studies, and International Relations.
