In particular, California is challenged to meet the NCLB requirement that by 2005-2006, all teachers be "highly qualified," meaning they must have a bachelor's degree, state certification (or be working towards a credential through an alternative route certification program), and have demonstrated knowledge in each subject they teach. In compliance with NCLB, California has adopted new regulations for teacher quality. Specifically, only teachers with full credentials or intern certificates/credentials will be considered "highly qualified."

Book excerpt: The federal "No Child Left Behind Act" (NCLB), the 2001 reauthorization of the Elementary and Secondary Education Act, seeks to improve student learning by setting high standards for academic achievement and putting into place basic school and district requirements to frame the improvement effort. Among those requirements considered to be paramount are the minimum standards for teacher qualifications, the equitable distribution of experienced teachers among schools, and the levy of federal sanctions on schools with low and stagnant academic performance. The law had originally required that every teacher of core academic subjects be "highly qualified" by the end of the 2005-06 school year but 29 states, including California, have been given a one-year extension to meet this requirement. The law also requires the balanced assignment of beginning and experienced teachers in order to relieve the persistent problem of the maldistribution of underprepared and novice teachers in low performing, high minority schools. This "CenterView" provides an update on California's progress in implementing the teacher quality provisions of NCLB. (Contains 1 exhibit and 1 footnote.).

Book excerpt: This book presents the latest developments related to the No Child Left Behind Act of 2001, legislation to extend and revise the Elementary and Secondary Education Act (ESEA), which was signed into law as P.L. 107-110 (H.R. 1). This legislation extensively amends and re-authorises many of the programs of federal aid to elementary and secondary education. Major features of the No Child Left Behind Act of 2001 include the following: (a) states will be required to implement standards-based assessments in reading and mathematics for pupils in each of grades 3-8 by the 2005-2006 school year, and at three grade levels in science by the 2007-2008 school year; (b) grants to states for assessment development are authorised; (c) all states will be required to participate in National Assessment of Educational Progress tests in 4th and 8th grade reading and mathematics every second year; (d) states must develop adequate yearly progress (AYP) standards, incorporating a goal of all pupils reaching a proficient or advanced level of achievement within 12 years, and apply them to each public school, local education agency (LEA), and the state overall; (e) a sequence of consequences, including public school choice and supplemental services options, would apply to schools and LEAs that fail to meet AYP standards for 2 or more consecutive years; (f) ESEA Title I allocation formulas are modified to increase targeting on high poverty states and LEAs and to move Puerto Rico gradually toward parity with the states; (g) within 3 years, all paraprofessionals paid with Title I funds must have completed at least 2 years of higher education or met a "rigorous standard of quality"; (h) several new programs aimed at improving reading instruction are authorised; (i) teacher programs are consolidated into a state grant authorising a wide range of activities such as teacher recruitment, professional development, and hiring; (j) states and LEAs participating in Title I have various requirements to ensure that teachers meet the bill's definition of "highly qualified" by the end of the 2005-2006 school year; (k) almost all states and LEAs are authorised to transfer a portion of the funds they receive under several programs, and selected states and LEAs may consolidate funds under certain programs through performance agreements; (l) federal support of public school choice is expanded; (m) several previous programs are consolidated into a state grant supporting integration of technology into K-12 education; (n) the Bilingual and Emergency Immigrant Education Acts are consolidated into a single formula grant, with existing limits on the share of grants for specific instructional approaches eliminated; and (o) the 21st Century Community Learning Center program is converted into a formula grant with increased focus on after-school activities.

Book excerpt: This policy brief presents a strong case for the creation of a statewide teacher data system in California by highlighting some of the simple teacher workforce questions that cannot be answered because such a system does not currently exist. At the state level, data on teacher qualifications are needed to fulfill the new reporting requirements of the federal No Child Left Behind Act (NCLB) and the recent Williams lawsuit settlement. At the county and district levels, local officials need reliable data to monitor the match between teachers' assignments and their credentials, understand what attracts teachers to the profession, and determine what contributes to their decision to leave it. State and local decision-makers need good data on the make-up of the K-12 teacher workforce. But in order to get this information, the state's teacher data system needs to be redesigned. The existing system also makes it difficult for local education agencies to compile data for reporting required under NCLB. This policy report pinpoints two primary and related problems representing deficiencies of California's available data: (1) Fragmented responsibility for collecting and reporting teacher data; and (2) Lack of a commonly used unique teacher identifier to allow linkage across data systems. The Center for the Future of Teaching and Learning offers the following seven recommendations: (1) A common identifier, such as teacher Social Security Number (SSN) or another unique teacher identifier should be used by all relevant agencies to enable longitudinal analysis and linkage across datasets; (2) An independent organizational structure should be adopted at the state level to oversee the teacher data system and ensure accuracy, validity and appropriate access over time; (3) Data collected by different agencies and/or organizations such as CCTC, CDE, STRS and statewide teacher programs should be merged on a regular, timely basis; (4) Analyses of the data in the teacher data system should be performed annually on a specified time line and made available to policy-makers and the public; (5) Measures to ensure access to the data for legitimate research should be established; (6) A regular system of accounting for data accuracy should be established to ensure that data and subsequent analyses are reliable; and (7) Standards should be developed and used across all involved agencies to protect teacher privacy and ensure appropriate uses of the data system for the purposes of evaluating programs and policies. The brief concluded by noting that an overhaul of California's teacher information system is long overdue. NCLB has presented the state with an opportunity to rethink the current system and redesign it to meet new federal reporting requirements.
