The reform of ‘old’ social organizations and the emergence of new, privately-initiated, non-profit organizations only began to occur in the 1980s, and such organizations continued to expand throughout the 1990s. Within a short period these new organizations have become a vibrant force in Chinese society. This unique volume – the first book in English to offer systematic and critical research in this field - is the outcome of a three-year research project on the Legal Aspects of Social Organisations in China. The main aim of the project was to encourage Chinese researchers to deepen their knowledge and understanding of the current status of social organizations in China, and to allow them to explore possible ways of creating a friendly legal environment conducive to the exercise of the right to freedom of association. The book contains some of the best results of the Chinese researchers’ work and papers presented by European experts at two international seminars, organized jointly by the Institute of Law of Chinese Academy of Social Sciences and Law Faculty of Utrecht University, The Netherlands. The contributions of the European experts explore different systems of regulation that have developed, and which are accommodated within the legal framework and traditions of each particular country. The aim of the volume is to stimulate international understanding of the progress made by China and the dilemmas it still faces with respect to its emerging new civil society organizations.

However, there is a need for a new perspective on this issue. Contemporary China, where a modern civil society remains in a nascent stage, offers a valuable site to seek new answers. Through a comparative analysis of nongovernmental organizations (NGOs) in today’s China, this study shows the importance of the human factor, notably the NGO leadership, in the establishment of a modern civil society. In particular, in recognition of the social nature of NGOs, this study engages in a comparative examination of Chinese NGO leaders’ state linkage, media connections and international ties in order to better understand how each factor contributes to effective NGOs.

However, an increasingly open economy is creating the infrastructure for an open society, with the rise of a non-state sector in which a private economy, non-governmental organizations (NGOs) and different forms of social forces are playing an increasingly powerful role in facilitating political change and promoting good governance. This book examines the development of the non-state sector and NGOs in China since the onset of reform in the late 1970s. It explores the major issues facing the non-state sector in China today, assesses the institutional barriers that are faced by its developing civil society, and compares China’s example with wider international experience. It shows how the ‘get-rich-quick’ ethos of the Deng Xiaoping and Jiang Zemin years, that prioritised rapid GDP growth above all else, has given way under the Jiantao Hu regime to a renewed concern with social reforms, in areas such as welfare, medical care, education, and public transportation. It demonstrates how this change has led to encouragement by the Hu government of the development of the non-state sector as a means to perform regulatory functions and to achieve effective provision of public and social services. It explores the tension between the government’s desire to keep the NGOs as "helping hands’ rather than as autonomous, independent organizations, and their ability to perform these roles successfully.

China is facing demographic and environmental challenges and has been experiencing a rapid economic transition. The social tensions arising from these challenges call for a governance system that will allow the Chinese leadership to alleviate social tensions without putting at risk their leadership. A society which is becoming more diverse and facing problems of a global scale that also cause turmoil at the grass roots may be difficult to govern top-down. Notwithstanding the Communist Party of China’s (CPC) grip on Chinese society, there may be ways to integrate public opinion and civil society organisations in governmental decision-making through reforms that do not challenge the current leadership. The EU, on the other hand, faces the same global challenges with a very different and complex governance system. EU foreign and security policy, thus including EU policy towards China, are governed by the EU’s foreign policy principles, which contain, among others, the promotion of democracy, the rule of law and the universality and indivisibility of human rights and fundamental freedoms. How successful can the EU be in advancing these principles when engaging with China, while respecting the Chinese political system? How can the EU and China find common grounds in their governance systems so as to enhance their strategic partnership in order to tackle global issues that need a coordinated approach?

The 48 Group Club a China friendly group of former UK ambassadors and Prime Ministers were embarrassed by their connections to a Club founded by key members of the Chinese Communist Party of Britain who's chair Stephen Perry suggested that China's approach to world order and rule was superior to democracy and the UK should embrace them. Asked if he believed the lawsuit was an effort by the Chinese government to stop the publication of his book, Mr. Hamilton said: “I have no evidence of that, although it should be noted that the Chinese government has used lawfare in the past.” Lawfare is the use of legal action as part of a campaign against a target. Governments around the world are in the early stages of a repositioning of power, as China rises and the United States is drawn into direct competition. However, some are beginning to wonder whether, for all of the economic benefits, engaging with China carries unseen dangers. The Chinese Communist Party is now determined to reshape the world in its image. The party is not interested in democracy. It divides the world into those who can be won over and enemies. They have already lured many leaders to their corner; others are weighing up a devil's bargain. Through its exercise of ‘sharp power,’ the party is weakening global institutions, aggressively targeting individual corporations, and threatening freedom of expression from the arts to academia. At the same time, security services are increasingly worried about incursions into our communications infrastructure. Indeed, the vaunted Great Firewall is a temporary measure, only necessary until the party has transformed the global conversation. In December 2019, the CCP's obsession with social control led it to suppress expert warnings about the coronavirus outbreak in Wuhan. Most alarming for the West was the active collaboration of the WHO in spreading the CCP's version of events. It was a shocking example of the widespread co-optation of global institutions by the CCP, as described in Hidden Hand. As soon as Beijing thought it had the virus under control, it began a global propaganda blitz, presenting China's authoritarian system as a model for the rest of the world. Western media and pundits soon began echoing the Party line. Hidden Hand is a detailed and devastating expose of Chinese Communist Party influence in the West, including Canada. It could not arrive at a better time in Canada, with relations between Ottawa and Beijing reaching breaking point after two years of mounting tension. China's bullying behaviour, and the mobilising of people loyal to the Chinese Communist Party on the streets of Canada's cities, has caused deep disquiet among Canadians. But the government seems paralyzed. Hidden Hand shows how Canada's political, business, academic and cultural elites have over many years been co-opted by the Chinese Communist Party and its agencies. They are confused about what is in Canada's national interests and frequently do Beijing's bidding.
