Book excerpt: Currently, international law refers to two different conventional legal sources in order to deal with the existence of a non-international armed conflict: Common Article 3 to the Geneva Conventions of 1949, and Article 1 of the 1977 Additional Protocol II. Yet, with the adoption of the Rome Statute of the International Criminal Court (ICC Statute), it was also recognized that certain war crimes could be committed during 'armed conflicts not of an international character'. Article 8(2)(c) and (e) grants the ICC with jurisdiction ratione materiae where serious violations of Common Article 3 and other serious violations of the laws and customs applicable in internal armed conflicts may have been committed. While the ICC Statute does not provide a more precise definition of the armed conflict in Article 8(2)(c), i.e. when serious violations of Common Article 3 may occur, it elucidates a definition in the case of serious violations of the laws and customs of war. The objective of this chapter is to clarify the threshold needed for the application of Article 8(2)(e) by focusing on the meaning of this provision. In doing so, it examines if indeed there are only as found in Common Article 3 and the 1977 Additional Protocol II, or if there is a third one included in the ICC Statute.

Book excerpt: This article puts forward an argument for a particular approach to the interpretation of the definition of non-international armed conflict in the Rome Statute of the International Criminal Court. Focusing on the meaning of Article 8(2)(f), it is contended that this provision possesses a threshold of an application equivalent to that of Article 3 common to the four Geneva Conventions of 1949. In supporting this position, the first half of the article analyses the travaux preparatoires of the Rome Statute. Here relevant clauses relating to non-international armed conflict are analysed in order to highlight the threshold of application intended by their drafters. Following on from the travaux preparatoires of the Rome Statute, the second half of the article puts forward an interpretation of the threshold contained in Article 8(2)(f) as one applicable to all situations of non-international armed conflict subject to the court's jurisdiction. Drawing, among other things, on the conventional usage of the term armed conflict not of an international character and the customary status of non-international armed conflict provisions in the Rome Statute, an argument is advanced for an understanding of the threshold contained in Article 8(2)(f) as the one identical to that of common Article 3.

The first part examines the origins of the 'armed conflict' concept and its development as the lower threshold for the application of international humanitarian law. Here the meaning of the term is traced from its use in the Hague Regulations of 1899 until the present day. The second part focuses on a number of contemporary developments which have affected the scope of non-international armed conflict. The case law of the International Criminal Tribunals for the former Yugoslavia has been especially influential and the definition of non-international armed conflict provided by this institution is examined in detail. It is argued that this concept represents the most authoritative definition of the threshold and that, despite differences in interpretation, there exist reasons to interpret an identical threshold of application in the Rome Statute.
