Book New Jersey Real Estate Brokerage Law 2017

Download or read book New Jersey Real Estate Brokerage Law 2017 written by Goodman S. Barry and published by New Jersey Law Journal. This book was released on 2016-11-24 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: New Jersey Real Estate Brokerage Law covers all of the essential areas that attorneys and real estate licensees must understand in order to navigate the explosive minefield of real estate brokerage law. The book covers everything they need to know concerning procedural issues, such as licensing and education requirements, regulations for maintaining offices, and the relationship between brokers and salespersons. It also lays out in a comprehensive fashion all of the disclosures that real estate licensees are required to make, the requirements of the Real Estate Commission concerning contracts of sale and leases that real estate licensees prepare, and the advertising rules that govern real estate licensees. Two separate chapters deal with the activities a real estate licensee is prohibited from engaging in, and the discipline that can face a real estate licensee for violating the Real Estate License Act or any of the Real Estate Commission's regulations that implement the Act. The book also covers the limitations on a real estate licensee's activities so that they will not constitute the unauthorized practice of law, including the attorney-review clause. Other topics covered include trade associations, multiple listing services, arbitration and the Code of Ethics governing NJAR(R) members. Although this book primarily focuses on New Jersey law, there are several Federal laws that real estate licensees must follow. Therefore, separate chapters deal with the Real Estate Settlement Procedures Act, the Fair Housing Act and lead-based paint disclosure requirements.

Available in PDF, EPUB and Kindle. Book excerpt: New Jersey has long been a breeding ground for political corruption, and most of it is perfectly legal. Public officials accept favors from lobbyists, give paid positions to relatives, and rig the electoral process to favor their cronies in a system where campaign money is used to buy government results. Such unethical behavior is known as “soft corruption,” and former New Jersey legislator William E. Schluter has been fighting it for the past fifty years. In this searing personal narrative, the former state senator recounts his fight to expose and reform these acts of government misconduct. Not afraid to cite specific cases of soft corruption in New Jersey politics, he paints a vivid portrait of public servants who care more about political power and personal gain than the public good. By recounting events that he witnessed firsthand in the Garden State, he provides dramatic illustrations of ills that afflict American politics nationwide. As he identifies five main forms of soft corruption, Schluter diagnoses the state government’s ethical malaise, and offers concrete policy suggestions for how it might be cured. Not simply a dive through the muck of New Jersey politics, Soft Corruption is an important first step to reforming our nation’s political system, a book that will inspire readers to demand that our elected officials can and must do better. Book Towards a Neutral Formulary Apportionment System in Regional Integration

Download or read book Towards a Neutral Formulary Apportionment System in Regional Integration written by Shu-Chien Chen and published by Kluwer Law International B.V.. This book was released on 2023-03-09 with total page 471 pages. Available in PDF, EPUB and Kindle. Book excerpt: International tax regimes and practices are heavily criticized for failing to fairly levy corporate tax on giant multinational taxpayers in the current globalized and digitalized world. This important and far-seeing book demonstrates how formulary apportionment (FA) – an approach by which a multinational corporation pays each jurisdiction’s corporate tax based on the share of its worldwide income allocated to that jurisdiction – can achieve the much-sought goal of aligning value creation and taxation. The author, through an intensive analysis of the European Union’s (EU’s) Common Consolidated Corporate Tax Base (CCCTB) Directive Proposal(s) and comparison to the United States (US’s) formulary apportionment experience, shows how the perceived problems with an FA system can be overcome and lays out the necessary elements for its feasibility. With detailed attention to the debates around formulary apportionment and its theoretical foundations, the book provides a blueprint for rebuilding the normative framework for the EU’s tax reform by clearly analysing the implications of the following and more: theorising public benefits to be represented by taxation; reorganising different economic theories about tax neutrality and tax justice; advancing the comparative legal research methodology to analyse law reform by combining the functional approach and the problem-solving approach; designing the logical formulary apportionment system for digital economy; ensuring the removal of the incentive for multinationals to shift reported income to low-tax locations; reducing the tax system’s complexity and the administrative burden it imposes on firms; eliminating transfer pricing complexity for intra-firm transactions; achieving equal weighting of the sales factor, the labour factor, and the asset factor in the formula; application of ‘destination-based’ rule for attributing the sales factor; and replacing the traditional permanent establishment nexus with a ‘factor presence nexus’. The presentation incorporates extensive comparison between the EU’s formulary apportionment tax reform option and FA systems existing in the United States (US) at state level, including reference to relevant US case law and legislation. As a possible option to address the problem of base erosion and profit shifting (BEPS), formulary apportionment is gaining increasing acceptance and attention. This book will prove invaluable to taxation authorities, tax practitioners, and scholars in its deeply informed and systematic guidance on good practices and prevention of problematic experiences in establishing and implementing an effective and market-neutral FA system.

Book The Geography of Risk

Download or read book The Geography of Risk written by Gilbert M. Gaul and published by Sarah Crichton Books. This book was released on 2019-09-03 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: This century has seen the costliest hurricanes in U.S. history—but who bears the brunt of these monster storms? Consider this: Five of the most expensive hurricanes in history have made landfall since 2005: Katrina ($160 billion), Ike ($40 billion), Sandy ($72 billion), Harvey ($125 billion), and Maria ($90 billion). With more property than ever in harm’s way, and the planet and oceans warming dangerously, it won’t be long before we see a $250 billion hurricane. Why? Because Americans have built $3 trillion worth of property in some of the riskiest places on earth: barrier islands and coastal floodplains. And they have been encouraged to do so by what Gilbert M. Gaul reveals in The Geography of Risk to be a confounding array of federal subsidies, tax breaks, low-interest loans, grants, and government flood insurance that shift the risk of life at the beach from private investors to public taxpayers, radically distorting common notions of risk. These federal incentives, Gaul argues, have resulted in one of the worst planning failures in American history, and the costs to taxpayers are reaching unsustainable levels. We have become responsible for a shocking array of coastal amenities: new roads, bridges, buildings, streetlights, tennis courts, marinas, gazebos, and even spoiled food after hurricanes. The Geography of Risk will forever change the way you think about the coasts, from the clash between economic interests and nature, to the heated politics of regulators and developers.
