Book The Construction of Commercial Contracts

Download or read book The Construction of Commercial Contracts written by JW Carter and published by Bloomsbury Publishing. This book was released on 2013-01-04 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book adopts a principled approach to the law applied in the construction of commercial contracts. This approach is presented as part of a coherent theory of the law of contract construction which makes a unique contribution to scholarship and understanding of the most important aspect of the practice of commercial lawyers. The law is explained by reference to three stages in construction. It distinguishes the preliminary stage in which context is established, from the 'meaning' and 'application' stages of contract construction. The approach provides insights both into the practical problems that lawyers face, in particular in relation to admissibility of extrinsic evidence, and the theoretical underpinnings of the subject. The book also explains the relationship between intention and construction, and discusses general and specific rules that determine the results of construction disputes. Each chapter is introduced by statements of its objectives and the book includes simple definitions of key concepts, as well as summaries of the complex principles which comprise the law of construction. In illustrating construction principles and their application, the exposition of the law draws on the author's knowledge of Australian contract law and the influence and role of the UNIDROIT principles, CISG and the American Restatement (Second) Contracts.

Book Responsible Management Education

Download or read book Responsible Management Education written by Ranjni Swamy and published by Business Expert Press. This book was released on 2017-10-04 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited collection emerged from the need to know how business schools in Asia are inculcating responsible management. Data for the book was sourced from (a) the workshop proceedings of the 6th PRME Asia Forum held in November 2015 and (b) case studies submitted as part of the Forum. Academics from India, China, Philippines, New Zealand, USA and Hong Kong (who taught in Asia) contributed to the workshop / the case studies. The book describes how some Asian business schools are incorporating ethics, social responsibility and sustainability into their curricular and extra-curricular activities. It identifies the challenges faced in providing such education and the implications thereof. In the process, it captures the unique flavour of Asian business schools. Business schools in Asia appear to have introduced several stand-alone courses on ethics and corporate responsibility. They have adopted pedagogies suited to the profile of their students. Many have promoted a concern for the poor through volunteering, projects or internships with NGOs. However, few have made responsible management a central part of their business school curriculum. Greater integration of responsible management into the curriculum requires supportive administrative policies, greater cross-functional interaction and the development of context-appropriate learning materials.

Book Global Development Finance 2006

Download or read book Global Development Finance 2006 written by World Bank and published by World Bank Publications. This book was released on 2006-01-01 with total page 702 pages. Available in PDF, EPUB and Kindle. Book excerpt: "International private capital flows to developing countries reached a record net level of $491 billion in 2005. This surge in private capital flows offers national and international policy makers a major opportunity to bolster development efforts if they can successfully meet three challenges. The first is to ensure that more countries, especially poorer ones, enhance their access to developmentally beneficial international capital through improvements in their macroeconomic performance, investment climate, and use of aid. The second is to avoid sudden capital flow reversals by redressing global imbalances through policies that recognize the growing interdependencies between developed and developing countries' financial and exchange rate relations in the determination of global financial liquidity and asset price movements. And the third is to ensure that development finance, both official and private, is managed judiciously to meet the development goals of recipient countries while promoting greater engagement with global financial markets. These are the themes and concerns of this year's edition of Global Development Finance. Vol I. Anlaysis and Statistical Appendix reviews recent trends in financial flows to developing countries. Vol II. Summary and Country Tables* includes comprehensive data for 138 countries, as well as summary data for regions and income groups."

Book Financial Market Bubbles and Crashes Second Edition

Download or read book Financial Market Bubbles and Crashes Second Edition written by Harold L. Vogel and published by Springer. This book was released on 2018-08-16 with total page 477 pages. Available in PDF, EPUB and Kindle. Book excerpt: Economists broadly define financial asset price bubbles as episodes in which prices rise with notable rapidity and depart from historically established asset valuation multiples and relationships. Financial economists have for decades attempted to study and interpret bubbles through the prisms of rational expectations, efficient markets, and equilibrium, arbitrage, and capital asset pricing models, but they have not made much if any progress toward a consistent and reliable theory that explains how and why bubbles (and crashes) evolve and can also be defined, measured, and compared. This book develops a new and different approach that is based on the central notion that bubbles and crashes reflect urgent short-side rationing, which means that, as such extreme conditions unfold, considerations of quantities owned or not owned begin to displace considerations of price.
