Available in PDF, EPUB and Kindle. Book excerpt: Nepal became the 147th member of the World Trade Organization (WTO) on 23 April 2004. It is the first least-developed country (LDC) to join the WTO through the full working party negotiations process. Nepal's Membership to the WTO was inspired by its aspirations to change and diversify the pattern of trade from Indo-Nepal vicinity to the global scale. This paper examines on the implications of the WTO Membership for Nepal's trade aspirations in especial conjunction with Nepal's trade relations with India. It focuses on the international trade pattern of Nepal in particular the agricultural trade. Since Nepal has negligible items of exportable merchandise, its international trade is substantially dependent on woolen carpets, ready-made garments, leather products, tea, cardamom, pulses, seeds, and other farm products. Nepal's bilateral and regional trade arrangements also play key role in its contemporary trade account. Nepal has bilateral trade relations with 17 countries and it is a Member of the South Asian Free Trade Agreement (SAFTA) and the Bay of Bengal Initiative for Multi-Sector Technical and Economic Cooperation (BIMSTEC). Thus, this paper also examines the effects and prospects of these bilateral and regional agreements on the international trade regime of Nepal.

Book excerpt: This study analyzes Nepal's trade policies and performance, identifies constraints to increasing trade competitiveness, and recommends policy changes and technical assistance to improve trade performance. The study is timely, as Nepal's interim Poverty Reduction Strategy Paper of 2003 assigns a key role to trade and exports as drivers of broad-based economic growth-one of the four main pillars of its strategy. Key conclusions of this report suggest Nepal's trade policies are generally sound, and the country is competitive in a variety of products. However, these positive factors are tempered by constraints that make Nepal's productivity among the lowest in the region, create an inhospitable business climate, and discourage foreign direct investment-a key conduit for export-market access and technology transfer. The most critical constraints are: 1) delays in customs and transshipment to India's Kolkata port; 2) high infrastructure costs, especially transport and power; 3) a rigid, formal labor market; and, 4) weak policy and institutions in the areas of taxation, investment and trade promotion. But Nepal's prudent macroeconomic stance throughout most of the 1990s, helped increase its competitiveness. Low levels of domestic borrowing by the public sector, the nominal anchor of an exchange-rate peg with India, and a large jump in remittances by expatriate Nepalese labor have enabled Nepal to maintain macroeconomic stability. Notwithstanding, and despite liberalization and growth of trade in the 1990s, the study shows that competitiveness of Nepal's economy is low, as measured by firm-level surveys in manufacturing, farm yields, and aggregate productivity estimates. Labor productivity in manufacturing and agriculture are among the lowest in the region, while manufacturing unit labor costs are among the highest, even though Nepal has comparative advantage in a range of agriculture and manufacturing products. This study shows how three key factors contribute to low price competitiveness and productivity in Nepal's economy: a) inadequate mechanisms and incentives for firms to acquire new technology, b) weak infrastructure, and, c) an unfavorable business climate. Conclusions suggest major impacts of trade on the poor can come from switching to high value cash crops from subsistence agriculture. Whatever the motivation for trade-related legal reform, our experience in the FAO Legal Office has been that besides the substantial costs involved, there are many challenges to successful and meaningful legal and institutional reforms. Legal drafters must therefore be well aware of the existing legal and administrative culture. They must also have a realistic appreciation of the resource constraints in the country, for inadequate resources certainly restrict the ability of implementing bodies to put new rules into practice. This study is about the nature and extent of these trade-related legal and institutional reforms with a particular focus on those of direct relevance to the agricultural sector. In addition to the sectoral focus on agriculture, the study places distinct emphasis on the challenges of developing countries in the implementation of trade-related international obligations in the agricultural sector. It derives from FAO's experience in advising countries on the implementation of agriculture-related WTO agreements, key elements of which are discussed and illustrated by three representative case studies.
