Their allocation, protection and regulation influence the way the risks, costs and benefits of an investment are shared. For investors, the protection of property rights is a tool to shelter their business interests from arbitrary host state interference. For local people affected by an investment project, it may offer an avenue to secure their livelihoods, through providing safeguards against arbitrary land takings. Tensions may arise between different sets of property rights, as host state regulation to strengthen local resource rights may raise project costs and interfere with investors' rights - for example, under the international-law regulatory taking doctrine, or "stabilization clauses" in investor-state contracts. While there are vast literatures about the international law on foreign investment, the human right to property, and national law on investment, land and natural resources in Africa, this study analyses in an integrated way how the different sets of property rights involved in an investment project are legally protected under applicable law, whether national, international or "transnational". The study explores whether the property rights of foreign investors and affected local people tend to enjoy differentiated legal protection; and, if so, whether the legal protection of "stronger" property rights may constrain efforts to strengthen "weaker" ones. This research question has both theoretical and practical implications. Differences in the strength of legal protection may affect negotiating power. Weak legal protection and negotiating power make local resource users vulnerable to arbitrary dispossession of their lands. From a theoretical standpoint, linking legal analysis to an analysis of negotiating power in foreign investment projects can provide insights on the relationship between law and power - in a globalised world, does the law serve more powerful interests, can it be used to empower disadvantaged groups, or is it rather irrelevant?.

Book excerpt: Access to land and property is vital to people's livelihoods in rural, peri-urban, and urban areas in Africa. People exert tremendous energy and imagination to have land claims recognized as rights with a variety of political, administrative, and legal institutions. This book is dedicated to a detailed analysis of how public authority and the state are formed through debates and struggles over property in the Upper East Region of Ghana. While scarcity may indeed promote exclusivity, the evidence from this book shows that when there are many institutions competing for the right to authorize claims to land, the result of an effort to unify and clarify the law is to intensify competition among them and weaken their legitimacy. The book particularly explores how state divestiture of land in 1979 encouraged competition between customary authorities and how the institution of the earthpriest was revived. Such processes are key to understanding property and authority in Africa.

Book excerpt: This anthology explores the political nature of making order through policing activities in densely populated spaces across Africa, Asia and Latin America. Based on ethnographic research, the chapters analyze this complex with respect to marginalized young men in Haiti, community policing members and national politicians in Swaziland as well as other individual and collective actors engaged in policing and politics in Indonesia, Swaziland, Ghana, South Africa, Mexico, Bolivia, Haiti and Sierra Leone. What these contexts have in common is a plurality of order-making practices. Not one institution monopolizes the means of violence or a de facto sovereign position to do so. A number of interests are played out simultaneously, entailing re-negotiations over the very definition of what ‘order’ is. How and by whom a particular order is enforced is contested, at times violently so, and is therefore inherently political. In the existing literature on weak states, legal pluralism and policing in the Global South it is seldom made explicit that making order is a route to power and positions of political decision-making. It is this gap in the literature that this anthology fills, as it analyses the politics at stake in processes of order-making.

With a case study of teak farming and sand winning in the Dormaa Municipality and Dormaa East district in midwestern Ghana, the work seeks to contribute to understanding the dynamics and role of institutions and human behaviour relationship in environmental governance. The study has been formulated and conducted following some observations of interaction between statutory and customary institutions in regulating human activities on the natural environment in Dormaa. Prior to this study, observations of this author in some communities in the Dormaa Municipality and Dormaa East district showed that statutory and customary environmental governance institutions influenced each other to shape the ways different people acted on the natural environment. Moreover, it was observed that the actions of people in turn influenced how these institutions functioned and affected each other.

Analysing the relationship between those reforms and change, the chapters in this book reveal not only their socio-economic outcomes, such as accelerated marketisation of land, but also their political outcomes, which have often been contrasting. Countries such as Rwanda and Mozambique have utilised land reform to strengthen state control over land, but other countries, such as Ghana and Zambia, have seen the rise in power of traditional chiefs in managing the land. The comparative perspective of this book clarifies new features of African social changes, which are carefully investigated by area experts. Providing new perspectives on recent land reform, this book will have a considerable impact on scholars as well as policymakers.

Taking an interdisciplinary approach on how livelihoods and landscapes in the Eastern Cape link the text provides a comprehensive study of the patterns of land use over time. Three separate chapters focus on cropping and cultivation practices, livestock and foraging as well as the gathering of wild plants. The book gives a vivid picture of the social dynamics and the interaction between ‘urban’ and ‘rural’. It depicts the steady deterioration in agricultural production and the corresponding increase in dependence on social grants and wages. Despite this trend remnants of a peasantry do exist.
