In 2000 and 2003, ICANN conducted a limited expansion of gTLDs [generic top-level domains]. In 2005 it initiated the process we are discussing today. After 6 years of multi-stakeholder discussion, including input from governments through the governmental advisory committee, ICANN approved the rules for the new gTLD program in the form of an applicant guidebook. Expansion of the gTLD space is expected to provide a platform for city, geographic, and internationalized domain names, among other things. This type of change to the DNS is expected to enhance consumer trust and choice and reinforce the global nature of the Internet. The Domain Name System (DNS) is the distributed set of databases residing in computers around the world that contain address numbers mapped to corresponding domain names, making it possible to send and receive messages and to access information from computers anywhere on the Internet. Many of the technical, operational, and management decisions regarding the DNS can have significant impacts on Internet-related policy issues such as intellectual property, privacy, Internet freedom, e-commerce, and cybersecurity. The DNS is managed and operated by a not-for-profit public benefit corporation called the Internet Corporation for Assigned Names and Numbers (ICANN). Because the Internet evolved from a network infrastructure created by the Department of Defense, the U.S. government originally owned and operated (primarily through private contractors) the key components of network architecture that enable the domain name system to function. A 1998 Memorandum of Understanding (MOU) between ICANN and the Department of Commerce (DOC) initiated a process intended to transition technical DNS coordination and management functions to a private-sector not-for-profit entity. Additionally, a contract between DOC and ICANN authorizes ICANN to perform various technical functions such as allocating IP address blocks, editing the root zone file, and coordinating the assignment of unique protocol numbers. By virtue of this contract and two other legal agreements, DOC exerts a legacy authority and stewardship over ICANN, and arguably has more influence over ICANN and the DNS than other national governments. On March 14, 2014, the DOC’s National Telecommunications and Information Administration (NTIA) announced its intention to transition its stewardship role and procedural authority over key domain name functions to the global Internet multistakeholder community. If a satisfactory transition and Internet governance mechanism can be achieved, NTIA stated that it would let its contract with ICANN expire as early as September 30, 2015. NTIA has also stated that it will not accept any transition proposal that would replace the NTIA role with a government-led or an intergovernmental organization solution. Legislation was introduced into the 113th Congress seeking to limit NTIA's ability to transfer its authority over certain domain name functions. Ultimately, the 113th Congress enacted two legislative provisions that address NTIA's proposed transition. Section 540 of the Consolidated and Further Continuing Appropriations Act, 2015 (P.L. 113-235) provided that during FY2015, NTIA may not use any appropriated funds to relinquish its responsibility with respect to Internet domain name system functions. Meanwhile, Section 1639 of the FY2015 National Defense Authorization Act (P.L. 113-235) contained Sense of Congress language on the future of the Internet and the .mil top-level domain. The 114th Congress is likely to closely examine the benefits and risks of NTIA's proposed transition of its authority over ICANN. As a transition plan is developed by ICANN and the Internet community, Congress will likely monitor and evaluate that plan, and seek assurances that an Internet and domain name system free of U.S. government stewardship will remain stable, secure, resilient, and open. Congress will also likely continue to monitor ICANN's rollout of the new generic top level domain (gTLD) program, while also assessing to what extent ongoing and future intergovernmental telecommunications conferences constitute an opportunity for some nations to increase intergovernmental control over the Internet. How these and other DNS-related issues (such as intellectual property, cybersecurity, and privacy) are ultimately addressed and resolved could have profound impacts on the continuing evolution of ICANN, the DNS, and the Internet.

Many of these names have gained economic, social, and political value, leading to conflicts over their ownership, especially names containing trademarked terms. Congress, in P.L. 105-305, directed the Department of Commerce to request the NRC to perform a study of these issues. When the study was initiated, steps were already underway to address the resolution of domain name conflicts, but the continued rapid expansion of the use of the Internet had raised a number of additional policy and technical issues. Furthermore, it became clear that the introduction of search engines and other tools for Internet navigation was affecting the DNS. Consequently, the study was expanded to include policy and technical issues related to the DNS in the context of Internet navigation. This report presents the NRC's assessment of the current state and future prospects of the DNS and Internet navigation, and its conclusions and recommendations concerning key technical and policy issues.

This team of 24 experts is responsible for developing and proposing protections for trademark holders. Such protections are needed to ensure that ICANN's proposal to create new generic Top-Level Domains (gTLDs) such as .BLOG does not result in increased cyber squatting, phishing attacks and costly defensive registrations of domain names in new gTLDs. But the IRT process itself requires certain procedural and substantive safeguards.The IRT's first teleconference occurs today, followed by its first in-person meeting in Washington, DC April 1-2. ICANN has issued no official announcement of the IRT's creation and has released no final list of IRT members. But given the importance of the IRT process, there must be maximum transparency throughout the IRT process consistent with ICANN's by-laws. This is especially critical with the pending expiration of ICANN's Joint Project Agreement with the U.S. government. Finally, maximum transparency is the only prudent course of action for the IRT because the risk of litigation from the new gTLD round is greater than the risk from previous TLD rounds. Here are the following recommendations to minimize both the chance for litigation and potential legal liability:* Maximize Openness and Transparency of the Implementation Review Team* Require all IRT members to disclose any direct or indirect financial interest* Dedicate a significant part of the next ICANN regional meeting to discussing each proposal prior to inclusion into the next Draft Applicant Guidebook* Develop a comprehensive bundle of reasonable policies to address concerns of trademark owners that can be implemented without causing an undue burden on either ICANN or the registries and registrars.

Instead of typing www.dot.com into your web browser, you will be able to enter www.dot.anything. This is because the organization in charge of domain names, the Internet Corporation for Assigned Names and Numbers (ICANN), has approved plans for the introduction of new generic Top Level Domain (gTLD) extensions. This dramatically increases the number of TLDs, with familiar domain extensions like .com, .org, and .net, from the current 22 to an unlimited number of TLDs. ICANN is rewriting the nomenclature for web addressing. More importantly, the expansion is likely to place an undue burden on government regulation and negatively impact trademark owners. During ICANN's incorporation in 1999, careful consideration was given to its technical functions, its obligation to the global public interest and its governance over the Internet. These considerations are captured in Article IV of ICANN's Articles of Incorporation and its Bylaws. Originally, the primary role of ICANN, which was incorporated as a “nonprofit public benefit corporation,” was to assume technical responsibility for the operational stability of the Internet. However, ICANN quickly realized, and subsequently announced that it was necessary to begin making policy decisions related to its technical function. In 2002, ICANN amended its Bylaws, a decision that was approved by the Board, and ICANN was allowed to start creating domain name policies by a vote of the Board, irrespective of consensus among the various stakeholders. The extent to which the ICANN board should be able to independently create these “technically related” policies has been a source of much controversy, intensified by debates surrounding the recent expansion of gTLDs. This Note examines whether ICANN's rationale for expanding gTLDs to increase “consumer choice,” contradicts its charter to “lessen the burden of government” in regulating the Internet. Part I outlines the scope and legal framework under which ICANN was chartered. Part II explores the structure of the Domain Name System and discusses the justifications for and against gTLD expansion. Part III reviews ICANN's planned gTLD application process and the proposed trademark protection mechanisms. Part IV determines the challenges the gTLD expansion may face and highlights the new burdens it will place on regulation and the impacts it will have on trademark owners. This Note concludes with proposals on how ICANN can comply with its charter.
