Book excerpt: Excerpt from Naval Law and Naval Courts And perhaps the most important of all, the Fifth Amendment, which provides that N 0 person shall be held to answer for a capital or otherwise infamous crime unless on a presentment or indictment of a Grand J ury, except in cases arising in the land or naval forces, or in the militia when in actual service in time of war or public danger. Military law, which as I have before stated, is operative both in peace and in war, is both written and unwrit ten, just as is the civil law. The written military law, so far as it applies to the navy, is founded upon the statutory code known as the Articles for the Government of the Navy; other statu tory provisions relating to the N avy; the Navy Regula tions, and general and special orders issued by the Department. Book excerpt: This collection of naval court martial transcripts and related documents from the time of the French Revolutionary and Napoleonic Wars contributes not only to our understanding of military jurisprudence in the late eighteenth and early nineteenth centuries but also to our knowledge of Georgian and Regency criminal law in general. Each chapter presents transcripts relating to different groups of offences. Chapter one deals with procedural matters; Chapter Two covers trails arising from transgressions of the laws of Georgian and Regency society like drunkenness, theft, violence and homosexuality. Chapter Three is devoted to proceedings against types of naval offence, such a mutiny, insolence, desertion or loss of ship. Chapter Four treats of cases involving adjudications for multiple infractions. These transcripts are presented in their entirety and offer a unique window to the social conditions and behaviour aboard the King's ships at the time.

It was certainly this, and for those who fought this is what they generally saw. Yet every foot of the struggles forward, every step of the retreats, the overwhelming victories, the withdrawals and last ditch stands had their seagoing support and overtones. The spectacular ones depended wholly on amphibious power -- the capability of the twentieth century scientific Navy to overwhelm land-bound forces at the point of contact. Yet the all pervading influence of the sea was present even when no major landing or retirement or reinforcement highlighted its effect. When navies clash in gigantic battle or hurl troops ashore under irresistible concentration of ship-borne guns and planes, nations understand that sea power is working. It is not so easy to understand that this tremendous force may effect its will silently, steadily, irresistibly even though no battles occur. No clearer example exists of this truth in wars dark record than in Korea. Communist-controlled North Korea had slight power at sea except for Soviet mines. So beyond this strong underwater phase the United States Navy and allies had little opposition on the water. It is, therefore, easy to fail to recognize the decisive role navies played in this war fought without large naval battles.
