The plans are directly linked to the groundbreaking research in the National Ecosystem Assessment that showed the strong economic arguments for safeguarding and enhancing the natural environment. They also act on the recommendations of 'Making Space for Nature', a report into the state of England's wildlife sites, led by Professor John Lawton and published in September 2010, which showed that England's wildlife sites are fragmented and not able to respond to the pressures of climate change and other pressures we put on our land. Key measures proposed include: i) Reconnecting nature with New Nature Improvement Areas (NIAs) with a £7.5 million fund for 12 initial NIAs, biodiversity offsetting, New Local Nature Partnerships with £1 million available this year, phasing out peat, ii) Connecting people and nature for better quality of life with Green Areas Designation, better urban green spaces; more children experiencing nature by learning outdoors, strengthening local public health activities, the new environmental volunteering initiative "Muck in 4 Life" to improve places in towns and countryside for people and nature to enjoy and iii) Capturing and improving the value of nature with a Natural Capital Committee; an annual statement of green accounts for UK Plc, a business-led Task Force to expand the UK business opportunities from new products and services which are good for the economy and nature alike.

The need to provide sustenance resulted in many people settling in areas where food could be raised for their families. Over the past century, however, a quiet shift from a rural to an urban society occurred, such that by 1920, for the first time, more members of our society lived in urban regions than in rural ones. This was made possible by changing agricultural practices. No longer must individuals raise their own food, and the number of person-hours and acreage required to produce food has steadily been decreasing because of technological advances, according to Roundtable member James Merchant of the University of Iowa. The Institute of Medicine's Roundtable on Environmental Health Science, Research, and Medicine held a regional workshop at the University of Iowa on November 29 and 30, 2004, to look at rural environmental health issues. Iowa, with its expanse of rural land area, growing agribusiness, aging population, and increasing immigrant population, provided an opportunity to explore environmental health in a region of the country that is not as densely populated. As many workshop participants agreed, the shifting agricultural practices as the country progresses from family operations to large-scale corporate farms will have impacts on environmental health. This report describes and summarizes the participants' presentations to the Roundtable members and the discussions that the members had with the presenters and participants at the workshop.

The Bill will introduce a long-term framework for the UK to achieve its goals of reducing carbon dioxide emissions and adapting to the impacts of climate change. The consultation document discusses the context and rationale behind the Climate Change Bill and sets out the main reasons why legislation in this area is required. The key elements of the Bill are: (1) setting targets in statute and carbon budgeting, with a statutory goal of a 60 per cent reduction in carbon dioxide emissions through domestic and international action by 2050, based on a new system of "carbon budgets" set at least fifteen years ahead (with reviews at five yearly intervals), and with progress reported annually to Parliament; (2) establishing an independent Committee on Climate Change to advise the government on how to reduce carbon emissions over time and across the economy; (3) creating enabling powers to allow the introduction of new domestic emissions trading schemes through secondary legislation; (4) reporting requirements will enhance the overall transparency and accountability of UK action on climate change, with the Committee on Climate Change reporting annually to Parliament on progress towards budgets and targets, with the Government required to produce a response to this independent report. Target setting alone cannot deliver policy objectives, but enshrining one in law will strengthen the Government's resolve to achieve it, ensure greater public accountability, and give confidence to the business community whose investment decisions are central to meeting the target. The Committee recommends a number of changes to the bill. Inconsistency in language, with "UK carbon account" and "UK carbon dioxide emissions" seemingly used interchangeably, should be addressed. There should not be an upper limit on the 2020 target (26-32 per cent reduction in carbon dioxide emission), and the Bill should make provision for both the 2020 and 2050 targets to be revised, though only in an upwards direction. The provision to amend a budget more than a year after the end of a budgetary period is seen as making a nonsense of the concept of budgetary periods, and should be removed completely. The proposed Committee on Climate Change, rightly composed of experts, should not appear to give more representation to economic interests over environmental ones. The resources proposed for the Committee may prove inadequate. The Committee recommends that the impact of climate change on biodiversity should be added to the Bill.

Book excerpt: Government is committed to conducting formal impact assessments of the need for and likely impact of new regulations. This National Audit Office report finds that scrutiny of proposed legislation is strengthening and that the standard is better than it was, but one fifth of assessments still do not include any quantified data to assess costs or benefits. The Better Regulation Executive (BRE) has introduced new guidance, templates and training to improve the quality of impact assessments and, as a result, impact assessments have clearer presentation of results, better planning for implementation, and more quantification of costs and benefits. But wide variation remains between the best and worst impact assessments. Where they are done well, the impact assessments include a clear statement of the policy problem, make good use of consultation and have clear recommendations. On the other hand, only 20 per cent of impact assessments presented the results of an evaluation of a range of regulatory options. Many impact assessments did not pay enough attention to compliance and enforcement issues. For example, only one third of assessments assessed the cost of enforcement for the preferred option. There have been improvements in the analysis of costs and benefits. In 2008, 67 per cent of impact assessments quantified costs and 60 per cent quantified benefits. Under the previous arrangements, the figures were 56 per cent for quantified costs and 40 per cent for quantified benefits. There is, however, still wide variation in the level of evidence provided and insufficient analysis in the weaker impact assessments.

The Government proposes to legislate to give people right of access on foot all around the English coast. The Committee remains dissatisfied about the uncertainty that surrounds the process of pre-legislative scrutiny as exemplified by this case. The Committee was surprised at the vague and uncommunicative way that the Government deals with the House in preparing for such scrutiny. When the Government is preparing draft bills in the future, it should inform the Liaison Committee which should recommend, in consultation with the relevant departmental select committee, how pre-legislative scrutiny should be conducted. The Bill places too much emphasis on trusting Natural England to "get it right" in terms of determining the alignment of the route and extent of spreading room; landowners and occupiers, in particular, are entitled to more concrete safeguards especially as the Government intends to strike a "fair balance" between public and private interests. The lack of a formal appeal process is a fundamental weakness of the Bill. The Committee is still to be convinced that £5 million a year for 10 years is enough to create access land all around England. The Government should also clarify responsibility for long-term maintenance before the Bill is introduced. The more detail Natural England can provide early on about how it intends to implement the policy in common coastal scenarios will reduce concerns. Natural England should produce a detailed draft of its Scheme before Parliament starts to consider the Bill. Natural England should have a statutory duty written into the Bill to conduct a review of the lessons it has learned from early implementation of the proposals.

The recommendations to introduce such a scheme would create a new legal tool, enabling landowners to protect land in order to conserve and restore our natural and built environment. Conservation covenants would allow landowners voluntarily to create binding obligations on their own land to meet a conservation objective, such as preserving woodland, cultivating a particular species of plant or protecting a habitat for an animal, or farming land in a certain way. The proposed statutory scheme would give individual landowners the opportunity, using private agreements, to contribute to conservation efforts being made across England and Wales. The scheme will create a versatile, simple and cost-effective legal tool capable of: unlocking currently missed conservation opportunities by overcoming the legal difficulties faced when creating binding obligations; facilitating better ways to deliver existing conservation objectives; and providing assurance of long-term conservation benefits. The report includes a draft Conservation Covenants Bill, which would introduce the conservation covenant scheme into the law of England and Wales.
