Book excerpt: The San Francisco Bay Delta Estuary is a large, complex estuarine ecosystem in California. It has been substantially altered by dikes, levees, channelization, pumps, human development, introduced species, dams on its tributary streams and contaminants. The Delta supplies water from the state's wetter northern regions to the drier southern regions and also serves as habitat for many species, some of which are threatened and endangered. The restoration of water exacerbated tensions over water allocation in recent years, and have led to various attempts to develop comprehensive plans to provide reliable water supplies and to protect the ecosystem. One of these plans is the Bay Delta Conservation Plan (BDCP). The report, A Review of the Use of Science and Adaptive Management in California's Draft Bay Delta Conservation Plan, determines that the plan is incomplete in a number of important areas and takes this opportunity to identify key scientific and structural gaps that, if addressed, could lead to a more successful and comprehensive final BDCP. The plan is missing the type of structure usually associated with current planning methods in which the goals and objectives are specified, alternative measure for achieving the objectives are introduced and analyzed, and a course of action in identified based on analytical optimization of economic, social, and environmental factors. Yet the panel underscores the importance of a credible and a robust BDCP in addressing the various water management problems that beset the Delta. A stronger, more complete, and more scientifically credible BDCP that effectively integrates and utilizes science could indeed pave the way toward the next generation of solutions to California's chronic water problems.

Book excerpt: The Bay Delta Conservation Plan (BDCP) is the state's current effort to attempt to accomplish the co-equal goals of a water supply reliability and ecosystem restoration. The BDCP is a proposed Habitat Conservation Plan and Natural Community Conservation Plan to provide State Water project facilities in the Sacramento-San Joaquin River Delta, operated by the California Department of Water resources, with Federal Endangered Species Act and California Endangered Species Act coverage for a 50-year permit term. The steering committee membership consists of 26 stakeholders who represent a broad coalition of interests ranging from agricultural users, environmentalists, and business interests who have been meeting since 2006. However, despite the investment of millions of dollars and hundreds of meetings that have been dedicated to this effort, many concerns about the future of the BDCP exist. The purpose of this study is to evaluate, at its mid-course point, the BDCP based on best practices in collaboration. To accomplish this a representative sample of the stakeholders were interviewed -- 18 in total. This data was then used to measure both process and outcomes through the use of several criteria in addition to the data gathered during the interview process. The main findings of the study demonstrated that key stakeholders are missing in the decision-making process. The data also indicated that the absence of key stakeholders increased the division between those actively at the table and those participating as "interested observers." This has resulted in a decrease in social capital and a power imbalance among participants. These and other findings are summarized and subsequent recommendations are offered to policymakers as the process moves forward.

Book excerpt: By passing the Natural Community Conservation Planning Act (NCCP), California created the most comprehensive, ecosystem-based conservation strategy in the United States. Although similar to the habitat conservation plans (HCPs) required by the federal Endangered Species Act, NCCPs were believed to be a step forward by focusing on protecting entire ecosystems, having a higher conservation standard, increasing public participation, giving more assurances to landowners, and having more local-level oversight. As this approach to conservation becomes more popular among stakeholders, it was necessary to determine whether or not society should continue to support this strategy. A modified snowball technique was used to identify study participants. A total of 64 in-depths interviews of major stakeholders were conducted. Participants included agency employees, attorneys, biologists, consultants, developers, members of environmental organizations, and policy analysts. This study found that although most stakeholders believed the NCCP rules, monitoring, and enforcement process were followed, they could still be improved, largely by an increase in resources. The study also determined that the majority of the stakeholders agreed adaptive management was adequately included; there would not be NCCPs without the "No Surprises" policy; and, no stakeholders were left out of the process. Most importantly, stakeholders were clearly willing to redesign the rules, monitoring, and enforcement process to improve the NCCP. The principal strengths cited included the NCCP as an ecosystem approach, the protection of listed and non-listed species, and the ability for stakeholders to reach consensus. Overwhelmingly, the stakeholders cited a lack of resources as the primary weakness of the NCCP. Other principal weaknesses included the NCCP was subject to political influence and it was a complex process. Although the majority of the stakeholders believed the NCCP was successful at preserving biodiversity while at the same time allowing for economic development to occur, several stakeholders noted that success could not be determined at this time, at least in terms of biodiversity preservation. Finally, a little over a third of the stakeholders stated the NCCP should not be adopted while the same number of respondents believed that the NCCP should be adopted on a case-by-case basis.
