Book excerpt: La question de la relation entre nationaux et étrangers en droit public connaît un certain nombre de mutations caractérisées par un apparent rapprochement des deux statuts juridiques et par leur redéfinition. La question est bien celle de la place que le droit public peut ou doit accorder à ceux qui vivent au sein de l'Etat mais n'en possèdent pas la nationalité et donc celle de l'actuelle signification donnée au lien de nationalité en droit public français. Cette signification semble dépendre à la fois du mode de distinction entre les concepts de national et d'étranger, c'est-à-dire de l'exercice de la souveraineté de l'Etat dans ce choix, et des statuts qui leur sont ensuite attachés en tant qu'ils sont liés par un élément primordial : la présence sur un même territoire. Ainsi, l'étranger, s'il n'est pas attaché à l'Etat par le lien de nationalité, est tout de même soumis au pouvoir étatique du fait de sa présence sur le territoire de l'Etat. Le droit relatif à la nationalité et à l'extranéité est avant tout un droit d'exclusion et de restriction qui conduit à reconnaître à l'étranger moins de droits qu'au national et qui codifie cette différence. Mais il est aussi, en parallèle, un droit d'intégration car il définit un statut de l'étranger dans l'Etat où il réside et en fait un sujet du droit de cet Etat. L'enjeu d'une étude des relations entre "nationaux" et "étrangers" est donc de questionner l'actuelle distinction juridique des deux concepts. Il s'agirait ainsi à la fois de réconcilier en la matière les deux expressions du pouvoir étatique : le pouvoir de commandement unilatéral fondé sur la contrainte et la conservation de l'autonomie et de la liberté reconnue à l'individu dans la société, et d'assurer l'équilibre entre une nécessaire différenciation des statuts, en raison de l'existence d'une communauté nationale qui fonde le pacte constitutionnel et qui est à distinguer de la simple société civile, et le respect des libertés individuelles au sein de l'Etat.

Book excerpt: La nationalité détermine la capacité de jouissance de l’intégralité des droits dans un Etat et l’extranéité entraîne, par définition, une inégalité des droits entre nationaux et étrangers. Toutefois l’application de plus en plus fréquente du principe d’égalité aux étrangers par les différentes juridictions, ainsi que l’affirmation croissante des droits attachés à la personne et non plus aux seuls citoyens ont entraîné un renouvellement du questionnement concernant l’égalité entre Français et étrangers. L’inégalité qui caractérisait le statut de l’étranger est en effet de plus en plus circonscrite à quelques domaines juridiques. D’une part, certains mécanismes spécifiques de la police des étrangers ont disparu et le juge accepte de soumettre la police des étrangers à un contrôle normal dans des cas de plus en plus nombreux. D’autre part, les fondements textuels de l’inégalité juridique entre nationaux et étrangers sont interprétés de manière de plus en plus restrictive. Enfin, l’autonomie normative du principe d’égalité produit une égalisation des conditions juridiques des nationaux et des étrangers. Le juge administratif comme le juge constitutionnel ont appliqué le principe d’égalité aux étrangers et considèrent que la différence de nationalité ne justifie pas nécessairement une différence de traitement et ne suffit pas à établir l’existence d’une différence de situation au regard de l’objet de la règle de droit. De plus, les sources du principe d’égalité se sont multipliées et de nombreuses normes internationales prescrivent un principe de non-discrimination. Le principe de non-discrimination en raison de la nationalité du droit communautaire et l’article 14 de la Convention européenne des droits de l’homme imposent ainsi une égalité des droits entre nationaux et étrangers. Toutefois, l’absence de droit absolu des étrangers au séjour sur le territoire relativise la portée de l’égalité et son application ne permet pas de consacrer une identité des droits avec les nationaux dans tous les domaines.

In his political history of the making and unmaking of the French absolute monarchy, Sahlins considers the shifting policies toward immigrants, foreign citizens, and state membership.Sahlins argues that the absolute citizen, exemplified in Louis XIV's attempt to tax all foreigners in 1697, gave way to new practices in the middle of the eighteenth century. This "citizenship revolution," long before 1789, produced changes in private and in political culture that led to the abolition of the distinction between foreigners and citizens. Sahlins shows how the Enlightenment and the political failure of the monarchy in France laid the foundations for the development of an exclusively political citizen, in opposition to the absolute citizen who had been above all a legal subject. The author completes his original book with a study of naturalization under Napoleon and the Bourbon Restoration. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.
