(2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.

Book excerpt: This case study of transportation policy for disabled people illustrates the flaws in policymaking that lead many Americans to believe government is not working as it should. Robert A. Katzmann examines the workings of the legislative, administrative, and judicial processes, both separately and in interaction, as he relates the erratic path of transportation policy for the disabled over two decades. An estimated 13.4 million people in this country have difficulty using public transportation, but the federal response to their problems of mobility is of fairly recent vintage, beginning with legislation in the early 1970s. Since then, there have been many twists and turns in policy, involving a wide array of governmental institutions. These constant shifts have confused state and local governments, the transit industry, and the disabled community. Assessing why policy was so erratic, Katzmann concludes that in part the confusion resulted from the inability to choose between conflicting approaches to the problem--one oriented toward the rights of equal access for the disabled, and the other favoring effective mobility by any practical means. In addition, the conflict between these two policy approaches was compounded by increasing fragmentation within and among national institutions.

A list of federal programs serving people with disabilities is prioritized according to federal expenditures, with an estimated number of persons with disabilities served. Summarized are the National Council on the Handicapped's legislative recommendations in 10 issue areas: equal opportunity laws; employment; disincentives to work under social security laws; prevention of disabilities; transportation; housing; community-based services for independent living; educating children with disabilities; personal assistance such as attendant services, readers, and interpreters; and coordination. The recommendations propose modifications in the expenditure of disability-related dollars to improve the ability of persons with disabilities to live with dignity and as independently as possible within their communities. Book excerpt: Over the last three decades, a number of reforms have taken place in European social policy with an impact on the opportunities for persons with disabilities to be full and active members of society. The policy reforms have aimed to change the balance between citizens’ rights and duties and the opportunities to enjoy choice and autonomy, live in the community and participate in political decision-making processes of importance for one’s life. How do the reforms influence the opportunities to exercise Active Citizenship? This volume presents the findings from the first cross-national comparison of how persons with disabilities reflexively make their way through the world, pursuing their own interests and values. The volume considers how their experiences, views and aspirations regarding participation vary across Europe. Based on retrospective life-course interviews, the volume examines the scope for agency on the part of persons with disabilities, i.e. the extent to which men and women with disabilities are able to make choices and pursue lives they have reasons to value. Drawing on structuration theory and the capability approach, the volume investigates the opportunities for exercising Active Citizenship among men and women in nine European countries. The volume identifies the policy implications of a process-oriented and multi-dimensional approach to Active Citizenship in European disability policy. It will appeal to policymakers and policy officials, as well as to researchers and students of disability studies, comparative social policy, international disability law and qualitative research methods.
