NIC members are appointed by the Director of National Intelligence and routinely support his office and the National Security Council. Congress occasionally requests that the NIC prepare specific estimates and other analytical products that may be used during consideration of legislation. It is the purpose of this report to describe the statutory provisions that authorize the NIC, provide a brief history of its work, and review its role within the Federal Government. The report will focus on congressional interaction with the NIC and describe various options for modifying congressional oversight. This report will be updated as new information becomes available.

Book excerpt: Although the appointment of the chairman of the National Intelligence Council (NIC) does not require the advice and consent of the Senate, the planned designation of retired Ambassador Charles Freeman to the position in March 2009 focused attention on the NIC by Members and by many in the public. [...] The first statutory responsibility of the DNI is to ensure that national intelligence is provided to the President, department heads, military commanders, and the Congress.2 Although this responsibility along with intelligence appropriations are sufficient to permit the DNI to establish analytical offices, the National Security Act also specifically establishes the NIC and defines its role at the [...] Members of the NIC serve on a full- time basis as the senior intelligence advisers of the intelligence community to the rest of the Federal Government. [...] The Office included a Board of National Estimates (BNE) consisting of some 5-12 experts, chaired by former Harvard historian William L. Langer.10 The BNE's estimates were to reflect the views of the entire intelligence community, not just the CIA; the goal was to ensure that the President and other senior officials had the collective wisdom of all agencies based on all evidence to avoid the mistak [...] Although the members of the BNE worked directly for the DCI, the relationship of the Office of National Estimates with the CIA's analytical component, the Directorate of Intelligence (DI), varied over the years.

Congressional and executive branch initiatives have emphasized improved cooperation among the different agencies that comprise the Community by giving greater coordination and managerial authority to the Director of Central Intelligence (DCI). The 9/11 Commission recommended that a new position of National Intelligence Director with even more extensive intelligence reorganization legislation, S. 2845, on December 7-8, 2004. Growing concerns about transnational threats, especially terrorism, are leading to increasingly close cooperation between the intelligence and law enforcement agencies. The September 11, 2001 terrorist attacks, for which no specific warning was provided, have led to increased emphasis on human intelligence, statutory changes permitting closer cooperation between the law enforcement and intelligence agencies, and to consideration of organizational changes to the Intelligence Community.

Book excerpt: The 9/11 Commission, in its recent report on the attacks of September 11, 2001, criticized the U.S. Intelligence Community's (IC) fragmented management structure and questioned whether the U.S. Government, and the IC, in particular, is organized adequately to direct resources and build the intelligence capabilities that the United States will need to counter terrorism, and to address the broader range of national security challenges in the decades ahead. The Commission made a number of recommendations, one of which was to replace the current position of Director of Central Intelligence (DCI) with a Director of National Intelligence (DNI) who would oversee national intelligence centers on specific subjects of interest -- including a National Counterterrorism Center (NCTC) -- across the U.S. Government; manage the national intelligence program; oversee the agencies that contribute to it; and have hiring, firing, and budgetary authority over the IC's 15 agencies. The Commission recommended that the director, and the NCTC, be located in the Executive Office of the President and that a deputy DNI be established to oversee the day-to-day operations of the Central Intelligence Agency (CIA). The Commission's recommendation to strengthen management authority over the IC is the latest contribution to an IC structural reform debate that dates at least to 1955, when arguments for stronger IC authority began to surface. OMB deputy director James Schlesinger in 1971 first broached the DNI concept. Recently, some Members of Congress introduced intelligence community reform legislation that would establish the position of DNI, or strengthen DCI authorities. Supporters argue that the DCI cannot manage the IC and the CIA and serve as the President's chief intelligence advisor, and do justice to any of the jobs. Opponents contend that placing the intelligence director in the Executive Office of the President risks the politicization of intelligence.

The directive instructed the Office of the Director of National Intelligence (ODNI) to produce a report within one year "assessing the feasibility of creating software that would allow the intelligence community more easily to conduct targeted information acquisition rather than bulk collection." ODNI asked the National Research Council (NRC)-the operating arm of the National Academy of Sciences and National Academy of Engineering-to conduct a study, which began in June 2014, to assist in preparing a response to the President. Over the ensuing months, a committee of experts appointed by the Research Council produced the report.
