Book excerpt: The purpose of this book is to provide a consolidated collection of materials to facilitate comparison of the various national human rights institutions (NHRIs) already established in the Asia-Pacific region, against a background of selected international materials and with the assistance of several comparative tables. The latter are not intended to be exhaustive, but are designed to assist in identifying and considering the strengths and weaknesses inherent in the legislative mandates of each national institution. While the collection is primarily intended for teaching purposes, it should also be useful to countries considering establishing a national human rights commission or, for those which have already done so, strengthening its mandate. For this reason several sections have been included outlining the relationship which should exist between NHRIs, the Executive, the Legislature, the Judiciary and other related institutions and a short section on the importance of the process which should precede their establishment.

Book excerpt: This book reviews Southeast Asia’s National Human Rights Institutions (NHRIs) as part of an emerging assessment of a nascent regional human rights architecture that is facing significant challenges in protecting human rights. The book asks, can NHRIs overcome its weaknesses and provide protection, including remedies, to victims of human rights abuses? Assessing NHRIs’ capacity to do so is vital as the future of human rights protection lies at the national level, and other parts of the architecture—the ASEAN Intergovernmental Commission on Human Rights (AICHR), and the international mechanism of the Universal Periodic Review (UPR)—though helpful, also have their limitations. The critical question the book addresses is whether NHRIs individually or collaboratively provide protection of fundamental human rights. The body of work offered in this book showcases the progress of the NHRIs in Southeast Asia where they also act as a barometer for the fluid political climate of their respective countries. Specifically, the book examines the NHRIs’ capacity to provide protection, notably through the pursuit of quasi-judicial functions, and concludes that this function has either been eroded due to political developments post-establishment or has not been included in the first place. The book’s findings point to the need for NHRIs to increase their effectiveness in the protection of human rights and invites readers and stakeholders to find ways of addressing this gap.

Interest in, concern about and action on human rights are widespread and rising, albeit in a far from globally even, uniform and untroubled fashion. Human rights have generated a booming global industry while having become, not unconnectedly, highly controversial and deeply contested. Human rights matters have emerged as a major source of disagreement, dispute and discord at and between the local, regional and global levels of social, cultural, political and economic life. These developments are addressed in the book by an examination of the links between the evolving global human rights regime (GHRR) and the character and course of human rights in the world's most dynamic, complex and problematic region, that of the Asia Pacific. The authors argue that although the Asia Pacific and human rights nexus is influenced by cultural clashes, it is largely shaped by power distributions and struggles rooted in the global political economy (GPE). The prevailing GHRR reflects the way in which globalization processes have been Western led, but its future is far from certain given the current shift in the balance of GPE power towards the Asia Pacific, and especially East Asia.

Book excerpt: The purpose of my dissertation is to examine whether and how national human rights institutions (NHRIs) can be a driving force for the establishment of regional human rights institutions (RHRIs) in the Asia-Pacific region, which remains the only region without such institutions in contrast to Europe, the Americas, and Africa. I first explore the issue of whether RHRIs are desirable in this region, and argue that such a system is desirable. Then I examine the reasons why RHRIs have not emerged in this region. I located these reasons in part by examining the reception of human rights in Asia and issues like the emergence of international human rights law from the Western cultural heritage, and the problematic question of what the Asian way of human rights means. The analysis of the obstacles that have hampered the creation of RHRIs leads me to focus on NHRIs. By reviewing the role that NHRIs can play in addressing the concerns and inhibitions of Asian states, while furthering the aims of international human rights law, I maintain that the way in which NHRIs collaborate demonstrates that they can be eminent actors toward the establishment of RHRIs. Further, I suggest four specific ways to realize this goal. Lastly, I explore the broader literature on the role that human rights NGOs can play in the relationship with RHRIs and NHRIs, thus illuminating their particular role in the Asian human rights context. I conclude that we need a new actor which can strengthen the human rights system at the national level, change a government's human rights policies, and ultimately lead to the creation of RHRIs in this region. It should be a channeling institution that can mediate between the national interest and international norms, similarly to RHRIs that can work as intermediaries to reflect the regional specificity and meet international human rights standards. At the same time, this new actor should gradually raise public awareness of human rights through an active cooperation with civil society. Overall, NHRIs can play such a role as a driving force for establishing RHRIs in the Asia-Pacific region.

Book excerpt: The Asia Pacific Forum of National Human Rights Institutions (APF) is a membership organisation of national human rights institutions (NHRIs) from across the Asia Pacific region. As at the end of 2008, there were 14 full members and three associate members. The underlying eligibility criterion for membership is compliance with the United Nations Principles Relating to the Status and Functions of National Institutions for the Promotion and Protection of Human Rights (the Paris Principles). Full membership is open to those NHRIs which comply with the Paris Principles, candidate membership is available to those which do not do not fully comply with them but which could do so within a reasonable period of time, and associate membership is available to those NHRIs which do not comply with the Paris Principles and are unlikely to do so within a reasonable period. This article explores the way in which APF membership criteria have been applied by the Forum in its assessment of applications for membership and for upgraded membership (and in its other activities), and considers whether this has resulted in greater compliance by potential and existing members of the APF with the Paris Principles. It examines the APF's activities in relation to its membership procedures within the framework of writing about transnational government networks as a form of international governance.

The institutions’ interaction with the UN Charter-based and Treaty-based Bodies is a relatively new phenomenon and as such, has its obstacles. In order to clarify the nature and ways of co-operation between NHRIs and the UN human rights monitoring mechanisms, this Handbook sets out the characteristics and role of National Human Rights Institutions in the UN human rights framework.
