The use of the military services by the Department of Defense to assist Federal, State, and local law enforcement agencies will offset advantages the illegal drug community has in trafficking and distribution of drugs into this country. The Secretary of Defense has directed the National Guard under Section 1105, Public Law 100-456, to provide support to law enforcement agencies in drug interdiction and eradication. The Chief, National Guard Bureau, has the responsibility to ensure that guidance from Congress is accomplished. The role of the military in support of Federal law enforcement agencies provides trained manpower and equipment necessary to fight the 'war on drugs.' The purpose for the employment of the Army National Guard is to contribute the manpower, training, and logistical support for drug interdiction and eradication requirements. These are accomplished at the ports of entry, border crossings, customs warehouses, and on lands growing illegal plants. Examination of the military's capability, based on previous employments of the force in this role, will show a marked improvement in the reduction and threat of illegal drug use. (edc).

Book excerpt: Pursuant to a congressional request, GAO reviewed the Office of the Secretary of Defense's (OSD) allocation of fiscal year (FY) 1989 and FY 1990 appropriations totalling $150 million to support an increased National Guard role in states' and territories' counter-drug activities. GAO found that: (1) OSD allocated $35.5 million of its $40-million FY 1989 appropriation and prioritized funding to states with the most pressing counter-drug interdiction needs; (2) OSD did not use states' priority rankings or evaluate mission priority, since states' requests and the amount of available funding were relatively close; (3) because OSD provided the funds late in the fiscal year, states were unable to spend $12.4 million, which they returned to the U.S. Treasury; (4) in FY 1990, OSD initially allocated $67.7 million of the $83.1 million states requested, on the basis of a rank-order list of counter-drug missions and a relative priority for each state; (5) OSD allocated $51.5 million of that initial funding to 21 states it identified as top-priority states; (6) OSD allocated $111.9 million for operational costs of states' counter-drug activities for FY 1991; (7) OSD planned to require states to specify funding priorities among the missions included in their FY 1992 requests; (8) as of January 1991, the National Guard Bureau had committed $17.1 million for ground-based radars, $7.1 million for thermal imaging radars, and $4.3 million for communications equipment to support the high-priority missions that OSD was funding; (9) the Bureau and the states' Guard organizations have not determined the amount or type of equipment to be purchased with FY 1991 funds; and (10) law enforcement agencies could not quantify the impact of the Guard's expanded support for their counter-drug activities, since the Guard did not independently plan, control, or execute operations.

Book excerpt: The peacetime mission of the National Guard (the Guard) is to protect life and property and to maintain peace, order, and public safety. As part of its peacetime mission, the Guard has been involved in support of counternarcotics activities since 1977. Over the past decade, the Guard has increased its emphasis on counternarcotics activities as concerns about illicit drug use in the United States have grown. The Guard began to quantify its support to counternarcotics efforts in 1983. In 1983, four states were involved in counternarcotics missions. By 1988, 32 states were involved in 456 marijuana eradication missions. These missions were accomplished by the Guard incidental to training and without Federal funding.

As a statute, the Posse Comitatus Act of 1878 prohibits the use of U.S. military forces to enforce civil law without a Presidential Proclamation of National Emergency. Drug interdiction requirements in the U.S. have exceeded the capability of civil authorities at all levels, federal, state, and local. The Congress mandated that the Department of Defense take the lead in this area. This places the military in the difficult position of executing a mission that encroaches on the intent of Posse Comitatus. The National Guard, by virtue of its unique dual role as a federal force, and as a state militia, is exempt from some of the restrictions imposed upon the active military. As such, the Guard is being committed to training missions under Title 32 of the U.S. Code in direct support to civil authorities. The extended use of the Guard in a drug interdiction role appears to violate the intent of Posse Comitatus. (jes).

Book excerpt: Active since 1987 in drug interdiction and other counter supply operations, the National Guard has recently completed a pilot program in Drug Demand Reduction, utilizing the states of New Mexico and New York as models. The initial success experienced by National Guard prevention efforts in each of these states indicates that the Guard can potentially be an effective force in conducting certain aspects of prevention operations at the state and local levels. Its resources, particularly the manpower and training that the Guard can bring to bear in this area, could make a significant difference if used properly to facilitate and support youth prevention efforts. The intent of this research project is to determine the effectiveness of specific National Guard prevention efforts in reducing the demand for illegal drugs among the youth of our country. The results of this study could be utilized to validate current programs and to target future National Guard initiatives in the prevention arena on a national, state, or community wide basis.
