The book first provides a summary of the Murray-Darling River system: its hydrology, water-related ecological assets, land uses (particularly irrigation), and its rural and regional communities; and management within the Basin, including catchments and natural resources, water resources, irrigation, environment, and monitoring and evaluation. Additionally, the recent major water reforms in the Basin are discussed, with a focus particularly on the development and implementation of the Basin Plan. Murray-Darling Basin, Australia: Its Future Management then provides an analysis of the next set of policy and institutional reforms (environmental, social, cultural and economic) needed to ensure the Basin is managed as an integrated system (including its water resources, catchment and estuary) capable of adapting to future changes. Six major challenges facing the Basin are identified and discussed, particularly within the context of predicted changes to the climate leading to an increased frequency of drought and a hotter and dryer future. How to finance the infrastructure and service of bulk water supply, and how to use pricing to achieve efficient allocation and use of water as a resource are the central issues that emerge from discussions about bulk water pricing. Efficiency will lead to allocating water resources better, reducing water losses caused by poor maintenance of the supply systems, and increased monitoring of water quality. At first glance, Brazil may not appear to be a relevant country from which to draw lessons in distributing scarce water resources, since it contains 12 percent of the world's fresh water supply. However, with its vast territory and issues of regional drought and population explosion, Brazil provides a unique environment in which to demonstrate how adequate pricing of bulk water on a regional level can help allocate water efficiently. This paper offers a framework for bulk water pricing reform and examines the lessons from recent analytical work and practice in Brazil, as well as relevant international experience. It then offers recommendations for the development of both water pricing and allocation policies to facilitate continued implementation of bulk water pricing in Brazil.

Water is an important human resource and water needs grow as populations grow. However, freshwater inflow to the coast is fundamental to the functioning of estuaries. Can we have stable, secure, and sufficient water resources for people and still protect estuarine health? Estuaries are the most productive environments on Earth, and this is in part due to freshwater inflow, which dilutes marine water, and transports nutrients and sediments to the coast. Estuaries are characterized by salinity and nutrient gradients, which are important in regulating many biological processes. As water is diverted for human consumption, it is common for many environmental problems to appear. While many countries have water quality programs, few are dealing with water quantity alterations. The first step is to define marine resources to protect, and the water quality conditions those resources need to thrive. The second step is to determine the flow regimes needed to maintain the desired water quality conditions. Finally, many regions are using adaptive management programs to manage freshwater resources. These programs set goals to protect ecosystem resources, identify indicators, and monitor the indicators over time to ensure that the goals are appropriate and resources are protected. Case studies demonstrate that monitoring and research can determine the ecological and socio-economical impacts of altered freshwater inflows, and stakeholders and managers can make well-informed decisions to manage freshwater inflows to local coasts wisely.

Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.
