Under the protection of the Federal Constitution the life and property of the citizen are governed and protected by state, not federal, laws. In his political capacity the citizen takes part in both the federal and the local government in accordance with state regulations. Acting under the state laws are the particular political units in which the citizen may reside - the county, city, or town. T o the authorities of these the citizen most fre quently looks for governmental support and regulation. Yet these local bodies are distinctly subordinate to and created by the authority of the state and are supervised and regulated by it. It is the purpose of this book to discuss the organization, the distribution of powers and functions, and the operation of these agencies of local government. Other books have dealt with state government and state administration or with munici pal government and municipal administration, but this book covers both state and municipal government, treating the two as a single manifestation of local government. This stage of fragmentary writing has been a necessary and an important one is developing the discussion and literary treatment of a new subject of large and growing significance. It would seem, however, that the time has now come for a more comprehensive and more systematic treatise, and it is an attempt in this direction that the writer makes bold to present this work. The title, "Municipal Administration," probably conveys a general idea of the subject to the minds of readers. Yet such is the vagueness and uncertainty with which words are used that it will be worth while to make the conception more exact by some definition of terms. Administration is a general term with the widest range of meaning, applying to the management of any kind of business. In reference to public affairs, administration is the detailed execution of general policies, the application of laws. It is to be contrasted and distinguished from legislation, and is indeed the work of public officials, established and set in operation by legislative measures. Municipal administration is that branch of public administration intrusted to municipal officials. The duties of such officials are almost exclusively of an administrative rather than a legislative character; and for that reason the title given is preferred to the less definite term "municipal government." Although the subject is one of unsurpassed practical importance, since nearly every considerable city and town in the United States is incorporated, no American work upon it has ever appeared. A careful examination of the English treatises satisfied the author that they were, in a great measure, inapplicable here, and that they fail to cover a large portion of the existing field of the law upon the subject as enlarged by American legislation and practice. True, our municipal system, like the body of our jurisprudence, was derived from England, but it is remarkable how many changes were necessary to adapt it to Our system of government and mode of administration, and to the wants and situation of our people. Accordingly, if the municipalities of the one country be closely compared with those of the other, it will be found that, in their structure, powers, and workings, they present quite as many points of difference as of similarity. The one function is legislation; the other administra tion. This distinction of governmental functions has been made from an early time and is at the basis of that fundamental principle of American constitutional law usually referred to as the principle of the separation of powers. It is a distinction based upon a sound psychology. In the case of a single sentient being the will must be formulated, if not expressed, before its execution is possible. In the case of political bodies, which are more and more coming to be recognized as subject to psychological law, not only must the will or policy be formulated before it can be executed, but also the very complexity of their operations makes it almost impossible to intrust the same authority as well with the execution as with the deter mination of the public policy. This is so not merely because the function of determining the public policy requires deliberation while the function of its execution requires quickness of action, but also because the burden of government is too great to permit of its being borne by any one authority. There has also been a marked improvement in the supervision and management of muni cipnl utilities, whether run directly by the city or by private concerns. The explanation for this lies in the fact that the responsibility is concentrated upon Officials who have adequate authority to produce results, and who know that in the eye of the people they are responsible. Bureaus of municipal research speak with aptness and propriety of the necessity of a mayor's eye which shall be all-seeing and far - seeing, and which shall be directed to all phases of municipal administration. Highly important though the mayor's eye is, still more important has been the public eye, which has gained in strength and clarity with the growth of a sound educated public Opinion in municipal affairs.
