Excerpt: ...I suppose there are more apartments than there are tenants. A great many buildings similar built about that time. There has been about ten built in the street since that time. The supply of the apartments exceeded the demand" (fol. 286). " There were blocks of houses uptown that did not have a tenant, and that came in competition with the apartments in my house " (fol. 297). Any reduction that may be figured out as existing in the rental value of the premises in suit is certainly not to be attributed to the elevated railroad, when the true causes are so manifest, and so thoroughly shown in the records of the trial of this action. The defendants' railroad is shown to be the main cause for the advance in fee values in this vicinity, and it is also positively shown that causes other than the operation of the railroad have depressed the rental values of buildings like plaintiff's house. If due weight had been given to this evidence, a conclusion that plaintiff had suffered either fee or rental damage could not have been reached. From all the evidence in this case to show the true reasons for the history of the values, both fee and rental, of plaintiff's premises and of premises in the vicinity, we respectfully urge that the learned Justice committed error in denying defendants' motion for a dismissal of the complaint, and in granting the plaintiff any amount as damage to the fee of her property, or as damages she may have suffered for loss of rental.
