Book excerpt: This book explores the exportation and application of European Union legislation beyond EU borders. It clarifies the means and instruments of the voluntary application of the EU’s norms by third countries and analyses in detail the process of legislative approximation between the EU and its East European neighbours. It also assesses the extent to which the EU is successful in promoting its legal standards abroad. The first part of the book addresses the EU’s mechanisms and instruments promoting the export of its own laws and practices to other countries. Key issues include the post-Lisbon constitutional basis for the EU’s engagement with its Eastern neighbours (Art. 8 TEU); the different methods of acquis export and the impact of a new generation of Association Agreements providing for the establishment of Deep and Comprehensive Free Trade Areas (DCFTAs) and, ultimately, a Neighbourhood Economic Community (NEC) between the EU and its Eastern partners. The second part of the book includes substantive country reports that analyse the process of legislative approximation and application of EU law in the Eastern Partnership countries and Russia, authored by leading academics from the countries concerned. While currently these countries are not working towards full EU membership, the EU encourages them to approximate and converge their legislation with the EU acquis. The book also offers a unique picture of current practice of the application of EU law by judiciaries in the countries of the Eastern Partnership and Russia. The book concludes with reflections on the multi-faceted character of legislative approximation and the challenges surrounding the application of EU law in the EU’s Eastern neighbourhood. The conclusions reached are highly informative as to the effectiveness of present and future EU external regional policies aimed at the promotion of EU common values and EU legislation into the legal orders of third countries.

In order to understand the complexity and limitations of the EU framework under the European Neighbourhood Policy (ENP) and the Eastern Partnership Initiative (EaP) – that is, to consider the interface between policy instruments, institutional structures, and multiple agents – one needs to adopt an original analytical perspective of practices to comprehensively assess the policies’ outcomes. This volume therefore offers an examination of social practices as implemented through the use of policy instruments and subsequently embedded into the existing/emergent social structures which shape and determine the EU-neighbours’ relations. To gauge success of the ENP in the eastern region, the manuscript pulls together a rich collection of geographical and thematic case-studies, joined by the overarching conceptual framework of practices. This study’s principal aims are to discern patterns of social practices which guide agents’ interactions in different policy areas; to explore the origin and effect of these practices (the role of dominant discourses, logistical imbalances, deliberate strategies, etc.); and to explicate the nature of the emerging social structures being established in the eastern region. This approach is distinctive from other constructivist undertakings as it allows to synergise the meanings of social actions (through the focus on agents and instruments), and their structural extensions (through the focus on emergent structures) across geo- and bio-political localities of the EU and its eastern neighbourhood. Focusing on the major powers and smaller countries of Eurasia, it argues that power in international relations is different from coercion and is rather a social contract between a leader state and follower states where reciprocity is key and where leadership relationships cannot be adequately explained by focusing solely on the leader. It challenges the perception that genuine regional leadership is quite common, contending instead that it is rare; that much more often major powers make claims for leadership; and that regional leadership does not indicate the status of a particular state, but rather the social role of the leader, which is recognized by its followers, a role which is always relative and based on communication and constant interaction with followers. The book highlights the important role followers play in recognizing regional power, the importance for a state's regional leadership strategy in creating and holding a valuable position attractive for followers and delivering greater value to followers compared to other potential leaders.

Today, however, the ever-worsening security situation in the region clearly shows that the aim has not been achieved. With wars in Ukraine, Syria and Libya, the Union’s neighbourhood can therefore better be described as ‘a ring of fire’. Does this means that the policy has failed and that an alternative policy towards the EU’s neighbours is needed? Or should these developments be seen as temporary setbacks caused by external factors beyond EU control? By comparing the EU’s approach to its eastern and southern neighbours, this volume seeks to answer such overarching questions. The authors find that the EU still has a potential role to play in providing regional security, but that this role also risks being increasingly undermined if it does not increasingly take into account the broader geostrategic realities in both regions.

It concludes that the EU’s democratization role in this region was, not surprisingly, weak within this time period. However, this weak role only took shape under four domestic and transnational conditions: (a) a higher cost-benefit balance of rule transfer, (b) a lower structural difficulty a given country would need to overcome on its way towards a democratic regime, (c) increased levels of authority distribution across branches of power, and (d) a higher extent of democratic diffusion resulting from regional interactions. In those countries where these domestic and transnational conditions were present, as in Moldova, Ukraine, and Georgia, the EU’s democratizing influence was in causal terms only the tip of the iceberg. Most variation in regime dynamics remains to be explained by domestic and transnational contexts.
