Concurrently, the new directive has introduced some measures of flexibility and important new requirements. This book focuses on the essence of these changes, starting with the definition of a public procurement contract, and ending with changes to concluded contracts. In between, essential aspects of the reform are analyzed, including the new rules on in house and public-public partnerships, on qualification, on the new and more flexible award procedures, including those aimed at fostering innovation. Specific attention is also paid to the new emphasis on strategic procurement, to the benefit of SMEs, and to the renewed efforts to exploit e-procurement and aggregated purchasing. Book excerpt: Since 2010, the government has made a number of changes to its procurement structures and processes. There have been signs of good progress in key areas: expenditure on common goods and services is more centralised; participation by small and medium enterprises (SMEs) has increased; and the Government Procurement Service is an improvement on its predecessor. The creation of a Chief Procurement Officer and associated positions has formed clearer lines of responsibility at the centre, and the Cabinet Office now has a firmer grip of procurement expenditure. Overall, the NAO expresses confidence in the Service's reported savings of £426 million in 2011-12 as a result of reductions in price owing to centralised procurement. Nevertheless, there have been problems in implementing the reforms, including ineffective governance structures, unrealistic targets, incomplete data and weaknesses in contract management. Government is not maximising the potential for savings through centralised procurement. There are some operational issues with GPS's management of the central contracts, with departments raising concerns about the inconsistency of contract management and the quality of customer service. And some weaknesses in implementation mean that the centralised approach is not releasing procurement resources in departments as originally expected. Roles and responsibilities for day-to-day contract management are unclear and there are inadequate mechanisms by which departments and the centre of government can hold each other to account. The Cabinet Office will have to lead a major cultural shift across government if the centralising of buying goods and services is to deliver the significant benefits on offer.

Book excerpt: The 2004 Gershon Efficiency Review proposed procurement as one of the main sources of efficiency savings in the public sector. The Learning and Skills Council, which funds England's 384 further education colleges, estimates that from an annual procurement expenditure of £1.6 billion, colleges could make savings of £75 million by March 2008. The savings made by colleges would be available to be redeployed into front-line services for learners. Until recently, many colleges have tended to treat procurement as a low priority and have not taken advantage of modern procurement methods such as purchasing consortia and procurement cards. They now need to modernise their systems so as to maximise the resources available for learning. Colleges increasingly have staff who are capable of managing procurement, but they are too often let down by the low quality of the systems and the management information available to them. There have been recent successes in persuading colleges of the benefits of joining purchasing consortia and using procurement cards. Indeed the savings target of £75 million may prove unambitious in light of the low starting point of many colleges. March 2008, when colleges make their first reports on savings to the Learning and Skills Council, will be a good time to consider whether greater savings can be made to be re-invested into services for learners.

This NAO report examines the procurement practices used by the 25 largest organisations which are responsible for 97 per cent of the sector's procurement spend. Findings include that, whilst there are examples of good practice, procurement capabilities and practices are on the whole underdeveloped across the sector, and that better procurement practice could result in overall annual savings of £14 million by 2008-09 and double this within five years. The report sets out recommendations for ways to make further efficiencies into procurement across the sector, including improving co-ordinating how organisations work together to share knowledge and resources and to harness their buying power.

Book excerpt: In this report the Committee of Public Accounts revisits the Prison Service's procurement system five years after publishing a critical report on it (41st report, session 2002-03, HC 676, ISBN 9780215012647). The Committee notes that the Service has responded positively and decisively. It has implemented a new strategy and introduced a centralised profession al procurement team, supported by five regional procurement teams and a new information technology system. As a direct result of implementing the Committee's recommendations the Service has generated cash savings of £120 million to 2007-08. Whenever problems have been encountered, the Service has addressed them promptly, including difficulties in phasing in its new computer system. Compliance with laid down procedures is being tightened, to ensure that all areas of the Service utilise the procurement system as effectively and efficiently as possible. The Ministry of Justice announced in October 2008 that it is to centralise procurement across the Ministry into a single function, which would include the Prison Service. With a potential budget of £2.5 billion, the new procurement function offers the opportunity to secure substantial savings.

This case changed the direction of how Services of General and Economic Interest (SGEI) should be funded in the EU against a background of liberalisation, and the need for efficiency and global competitiveness. The book examines the European Commission’s response to the Altmark ruling in the measures known as the ‘Altmark-Monti-Kroes Package’ and charts the review of this package from 2009 culminating in a new package of measures, known as the ‘Almunia Package’. The seemingly technocratic idea of a review of the ‘Altmark-Monti-Kroes Package’ could not have anticipated the demanding and changed economic and constitutional context of the EU in 2009.
