Book Modern GATT Law Obligations

Download or read book Modern GATT Law Obligations written by Raj Bhala and published by . This book was released on 2013 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: It would be an overstatement to say every international trade law issue is a GATT issue. But, when the stunning breadth, profound depth, rich history, and contemporary significance of the General Agreement on Tariffs and Trade are appreciated, then so, too, is the stark fact that the overstatement is modest at best. Coming to that appreciation, and providing practicing lawyers and legal scholars with a comprehensive, user-friendly treatment of each of the Articles in GATT, is the purpose of Modern GATT Law. Scarcely a trade issue does not implicate, at least indirectly, a concept expressed in GATT. Many trade issues directly impact one or more of the 38 Articles of GATT (39, counting Article XXVIII bis as a separate one). Every year a large percentage of cases that reach the Appellate Body of the World Trade Organization (WTO) raise GATT claims or defenses. That fact alone is a raison d'tre for Modern GATT Law. The justification is yet more compelling, because the book is the first treatise on GATT in nearly 40 years. It covers the entire span of GATT jurisprudence, along with the interdisciplinary, especially economic, principles that provide essential context

Book Enforcing International Trade Law

Download or read book Enforcing International Trade Law written by Robert E. Hudec and published by MICHIE. This book was released on 1993 with total page 664 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book presents a history and analysis of the GATT legal system as it stands today at the beginning of the 1990s. Although the origins of GATT law go back to the GATT/ITO negotiations of 1946-1948 and beyond, the current legal system is largely the product of a reconstruction that took place from 1970 onwards. The book focuses on the evolution of GATT law during this modern period. It concentrates on the development of GATT's procedure for adjudicating legal disputes between member countries, known in GATT parlance as the "dispute settlement procedure". -- from the Preface, p. vii.

Book Legal and Economic Principles of World Trade Law

Download or read book Legal and Economic Principles of World Trade Law written by Henrik Horn and published by Cambridge University Press. This book was released on 2013-04-22 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: The World Trade Organization (WTO) Agreement covers international commerce in goods and services including measures that directly affect trade, such as import tariffs and quotas, and almost any type of internal measure with an impact on trade. Legal and Economic Principles of World Trade Law contributes to the analysis of the texts of World Trade Law in law and economics, reporting work done to identify improvements to the interpretation of the Agreement. It starts with background studies, the first summarizes The Genesis of the GATT, which highlights the negotiating history of the GATT 1947–8; the second introduces the economics of trade agreements. These are followed by two main studies. The first, authored by Bagwell, Staiger and Sykes, discusses legal and economic aspects of the GATT regulation of border policy instruments, such as import tariffs and import quotas. The second, written by Grossman, Horn and Mavroidis, focuses on the core provision for the regulation of domestic policy instruments - the National Treatment principles in Art. III GATT.

Book Treaty Interpretation by the WTO Appellate Body

Download or read book Treaty Interpretation by the WTO Appellate Body written by Isabelle Van Damme and published by . This book was released on 2009 with total page 487 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes how the Appellate Body uses particular principles of general international law in interpreting the WTO covered agreements. It deals equally with general international law and WTO law. The aim is to explain how the Appellate Body interprets and applies customary international law on treaty interpretation in dealing with the WTO covered agreements. The main concern is to analyze the judicial reasoning and ways of justifying judicial decision-making. In particular, it answers the question of how the Appellate Body explains its reading of WTO treaty language. It is argued that the Appellate Body has interpreted the WTO covered agreements in a contextual and effective manner, an approach that corresponds with general international law. The character of the WTO covered agreements has, nevertheless, confronted the Appellate Body with some questions of interpretation that were until recently unexplored or neglected by other courts and tribunals. In that sense, the Appellate Body has contributed to the development of general international law on treaty interpretation, or at least to its practice. WTO law is primarily treaty law, but increasingly soft law and broader themes and values from other disciplines, such as governance, variable geometry and legitimacy, are introduced and discussed. Customary international law - with the exception of the principles of treaty interpretation - and general principles of law are often seen as excluded entirely. An ancillary theme of this proposed monograph is the extent to which customary international law and general principles of law have penetrated WTO law through the technique of treaty interpretation.
