Book excerpt: This book contains a collection of peer-reviewed papers presented at the Eleventh Biennial Modern Studies in Property Law Conference held at Queen's University Belfast in April 2016. It is the ninth volume to be published under the name of the Conference. The Conference and its published proceedings have become an established forum for property lawyers from around the world to showcase current research in the discipline. This collection reflects the diversity and contemporary relevance of modern research in property law. Following a foreword from the keynote speaker at the Conference, Queen's alumnus Lord Kerr of Tonaghmore, the chapters address a range of issues, from the nature of land law and property rights, through claims to the home and digital assets, to the growing debate on the nature of public property. Collectively the chapters demonstrate the vibrancy and importance of property law in dealing with modern concerns across the common law world.

Book Foundational Texts in Modern Criminal Law

Download or read book Foundational Texts in Modern Criminal Law written by Markus D Dubber and published by OUP Oxford. This book was released on 2014-08-21 with total page 886 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foundational Texts in Modern Criminal Law presents essays in which scholars from various countries and legal systems engage critically with formative texts in criminal legal thought since Hobbes. It examines the emergence of a transnational canon of criminal law by documenting its intellectual and disciplinary history and provides a snapshot of contemporary work on criminal law within that historical and comparative context. Criminal law discourse has become, and will continue to become, more international and comparative, and in this sense global: the long-standing parochialism of criminal law scholarship and doctrine is giving way to a broad exploration of the foundations of modern criminal law. The present book advances this promising scholarly and doctrinal project by making available key texts, including several not previously available in English translation, from the common law and civil law traditions, accompanied by contributions from leading representatives of both systems.

Download or read book Distant Islands written by Daniel H. Inouye and published by University Press of Colorado. This book was released on 2018-11-15 with total page 387 pages. Available in PDF, EPUB and Kindle. Book excerpt: Distant Islands is a modern narrative history of the Japanese American community in New York City between America's centennial year and the Great Depression of the 1930s. Often overshadowed in historical literature by the Japanese diaspora on the West Coast, this community, which dates back to the 1870s, has its own fascinating history. The New York Japanese American community was a composite of several micro communities divided along status, class, geographic, and religious lines. Using a wealth of primary sources—oral histories, memoirs, newspapers, government documents, photographs, and more—Daniel H. Inouye tells the stories of the business and professional elites, mid-sized merchants, small business owners, working-class families, menial laborers, and students that made up these communities. The book presents new knowledge about the history of Japanese immigrants in the United States and makes a novel and persuasive argument about the primacy of class and status stratification and relatively weak ethnic cohesion and solidarity in New York City, compared to the pervading understanding of nikkei on the West Coast. While a few prior studies have identified social stratification in other nikkei communities, this book presents the first full exploration of the subject and additionally draws parallels to divisions in German American communities. Distant Islands is a unique and nuanced historical account of an American ethnic community that reveals the common humanity of pioneering Japanese New Yorkers despite diverse socioeconomic backgrounds and life stories. It will be of interest to general readers, students, and scholars interested in Asian American studies, immigration and ethnic studies, sociology, and history. Book Lawyers and Savages

  • Pages : 252 pages

Download or read book Lawyers and Savages written by Kaius Tuori and published by Routledge. This book was released on 2014-09-19 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal primitivism was a complex phenomenon that combined the study of early European legal traditions with studies of the legal customs of indigenous peoples. Lawyers and Savages: Ancient History and Legal Realism in the Making of Legal Anthropology explores the rise and fall of legal primitivism, and its connection to the colonial encounter. Through examples such as blood feuds, communalism, ordeals, ritual formalism and polygamy, this book traces the intellectual revolution of legal anthropology and demonstrates how this scholarship had a clear impact in legitimating the colonial experience. Detailing how legal realism drew on anthropology in order to help counter the hypothetical constructs of legal formalism, this book also shows how, despite their explicit rejection, the central themes of primitive law continue to influence current ideas – about indigenous legal systems, but also of the place and role of law in development. Written in an engaging style and rich in examples from history and literature, this book will be invaluable to those with interests in legal realism, legal history or legal anthropology.
