Book excerpt: The Mobile Homes Act 2013 amends the Caravan Sites and Control of Development Act 1960 ('the CSCDA 1960'), the Caravan Sites Act 1968 ('the CSA 1968') and the Mobile Homes Act 1983 ('the MHA 1983')It brings the licensing regime that applies to mobile home sites in England under the CSCDA 1960 more closely in line with other local authority licensing regimes and also includes a power to enable the Secretary of State to introduce by way of secondary legislation a "fit and proper" person requirement for managers of sites. The Bill amends section 3 of the CSA 1968 by extending the scope of the offences under that section. It amends the MHA 1983 by removing the requirement for site owners to approve a purchaser of a mobile home (or a person to whom a mobile home has been gifted) and makes new provisions instead for sales , gifts and assignments under the MHA 1983It also introduces new requirements about site rules and provides a framework for better transparency on pitch fee reviews.

This book was released on 2012-06-20 with total page 56 pages. Available in PDF, EPUB and Kindle. Book excerpt: While it is recognised that there are some good park home site operators, the vast majority of the evidence received suggests that malpractice is widespread across the sector. The most widespread problems identified include: 'sale blocking' - withholding 'approval' of prospective sales possibly forcing vendors to sell their homes at a reduced price and before selling at a profit; harassment by site owners; a licensing regime which allows site owners to breach licence conditions with a maximum fine of only £2,500; and confusion over contractual obligations which leaves residents with little or no ability to take action if the site is not properly maintained. The Committee recommends legislation to remove a site owner's existing 'right to approve' buyers. To compensate for this, sellers would have to make buyers aware of their obligations towards a site and its owner in writing before sale transactions take place. Pending this legislation, clearer powers for the Residential Property Tribunal to award damages is needed. The licensing regime must be modernised. New legislation is needed to make site owner obligations clear and to require the deposit of site rules with local authorities. The Committee welcomes the Government's consultation A Better Deal for Mobile Home Owners, but warns that more needs to be done. If the expected improvements do not happen, then the new legislation must provide a power for the Government to allow local authorities to withdraw and withhold licences from site owners found not to be 'fit and proper'. This provision should be activated if problems are persisting.

Book The Law and Elderly People

Download or read book The Law and Elderly People written by Aled Griffiths and published by Routledge. This book was released on 2005-06-28 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although the number of elderly people in Britain is increasing steadily, the law in relation to their particular needs is a relatively neglected field. The Law and Elderly People was the first text to provide easily accessible information for those involved in advice-giving and service provision in this rapidly developing field. This second edition has been fully revised and completely updated to reflect the major legal and social changes which have recently occurred. Concerned for the independence and autonomy of both young elderly and the old elderly, the book covers employment and income, accomodation and housing, community and residential care, health provision and delivery and family relationships, thus providing an important guide to the most important legal issues. The Law and Elderly People will be of practical help to all those concerned with the welfare of the elderly and to undergraduates and lecturers in social work, law and gerontology.
