Book excerpt: The Rule of Law in Action in Democratic Athens examines how the Athenians attempted to enforce and apply the law when judging disputes in court. Recent scholarship has paid considerable attention to the practice and execution of Greek law. However, much of this work has left several flawed assumptions unchallenged, such as that Athenian law was primarily concerned with procedure; that the main task of enforcement lay in the hands of private citizens; that the Athenians used the courts not to uphold the law but to pursue personal feuds; and that the Athenian courts rendered ad hoc judgments and paid little attention to the letter of the law. Drawing on modern legal theory, the author examines the nature of "open texture" in Athenian law and reveals that the Athenians were much more sophisticated in their approach to law than many modern scholars have assumed, and thus breaks considerable new ground in the field. At the same time, the book studies the weaknesses of the Athenian legal system and how they contributed to Athens' defeat in the Peloponnesian War. By reexamining the available evidence, Edward Harris provides a much needed corrective to long-held views and places the Athenian administration of justice in its broad political and social context.

Classical oratory is an invaluable resource for the study of ancient Greek life and culture. The speeches offer evidence on Greek moral views, social and economic conditions, political and social ideology, law and legal procedure, and other aspects of Athenian culture that have recently been attracting particular interest: women and family life, slavery, and religion, to name just a few. This volume contains translations of all the surviving deliberative speeches of Demosthenes (plus two that are almost certainly not his, although they have been passed down as part of his corpus), as well as the text of a letter from Philip of Macedon to the Athenians. All of the speeches were purportedly written to be delivered to the Athenian assembly and are in fact almost the only examples in Attic oratory of the genre of deliberative oratory. In the Olynthiac and Philippic speeches, Demosthenes identifies the Macedonian king Philip as a major threat to Athens and urges direct action against him. The Philippic speeches later inspired the Roman orator Cicero in his own attacks against Mark Antony, and became one of Demosthenes' claims to fame throughout history.

It explores the post-classical origins and changing meanings of the term 'anachronism' as well as the presence of anachronism in all its forms in classical literature, criticism and material objects. Contrary to the position taken by many modern philosophers of history, this book argues that classical antiquity had a rich and varied understanding of historical difference, which is reflected in sophisticated notions of anachronism. This central hypothesis is tested by an examination of attitudes to temporal errors in ancient literary texts and chronological writings and by analysing notions of anachronistic survival and multitemporality. Rather than seeing a sense of anachronism as something that separates modernity from antiquity, the book suggests that in both ancient writings and their modern receptions chronological rupture can be used as a way of creating a dialogue between past and present. With a selection of case-studies and theoretical discussions presented in a manner suitable for scholars and students both of classical antiquity and of modern history, anthropology, and visual culture, the book's ambition is to offer a new conceptual map of antiquity through the notion of anachronism.

However, while Athenian civic life and thought in the Classical period have been intensively studied, these aspects of the Hellenistic period have so far received much less attention. This volume seeks to bring together the two areas of research, shedding new light on these complementary parts of the history of the ancient Greek polis. The essays collected here encompass historical, philosophical, and literary approaches to the various Hellenistic responses to and adaptations of Classical Athenian politics. They survey the complex processes through which Athenian democratic ideals of equality, freedom, and civic virtue were emphasized, challenged, blunted, or reshaped in different Hellenistic contexts and genres. They also consider the reception, in the changed political circumstances, of Classical Athenian non- and anti-democratic political thought. This makes it possible to investigate how competing Classical Athenian ideas about the value or shortcomings of democracy and civic community continued to echo through new political debates in Hellenistic cities and schools.
