Book excerpt: Miracles and Sacrilege is the story of the epochal conflict between censorship and freedom in film, recounted through an in-depth analysis of the U.S. Supreme Court’s decision striking down a government ban on Roberto Rossellini’s film The Miracle (1950). In this extraordinary case, the Court ultimately chose to abandon its own longstanding determination that film comprised a mere ‘business’ unworthy of free-speech rights, declaring for the first time that the First Amendment barred government from banning any film as ‘sacreligious.’ Using legal briefs, affidavits, and other court records, as well as letters, memoranda, and other archival materials to elucidate what was at issue in the case, William Bruce Johnson also analyzes the social, cultural, and religious elements that form the background of this complex and hard-fought controversy, focusing particularly on the fundamental role played by the Catholic Church in the history of film censorship. Tracing the development of the Church in the United States, Johnson discusses the reasons it found The Miracle sacrilegious and how it attained the power to persuade civil authorities to ban it. The Court’s decision was not only a milestone in the law of church-state relations, but it paved the way for a succession of later decisions which gradually established a firm legal basis for freedom of expression in the arts.

In the 1980s, repatriation became the preferred option for resolving the refugee crisis. As human rights achieved global eminence, refugees' right of return fell under its umbrella. Yet return as a right and its practice as a rite created a radical disconnect between principle and everyday practice, and the repatriation of refugees and Internally Displaced Persons (IDPs) remains elusive in cases of forced displacement of victims by ethnic conflict. Reviewing cases of ethnic displacement throughout the twentieth century in Europe, Asia, and Africa, Howard Adelman and Elazar Barkan juxtapose the empirical lack of repatriation in cases of ethnic conflict, unless accompanied by coercion. The emphasis on repatriation during the last several decades has obscured other options, leaving refugees to spend years warehoused in camps. Repatriation takes place when identity, defined by ethnicity or religion, is not at the center of the displacing conflict, or when the ethnic group to which the refugees belong are not a minority in their original country or in the region to which they want to return. Rather than perpetuate a ritual belief in return as a right without the prospect of realization, Adelman and Barkan call for solutions that bracket return as a primary focus in cases of ethnic conflict.

This evolving public-private network—which united the US Department of Agriculture, Congress, local and national organizations, and the agricultural industry—guided soil and water conservation in rural America for much of the century. Nygren demonstrates how the conservation policies, programs, and partnerships of the 1930s and 1940s persisted through the age of environmentalism, and how their defining traits anticipated those typically associated with late twentieth-century political culture. As World War II drew to a close and the world awakened to the horror wrought by white supremacists in Nazi Germany, African American leaders, led by the NAACP (National Association for the Advancement of Colored People), sensed the opportunity to launch an offensive against the conditions of segregation and inequality in America. The 'prize' they sought was not civil rights, but human rights. Only the human rights lexicon, shaped by the Holocaust and articulated by the United Nations, contained the language and the moral power to address not only the political and legal inequality but also the education, health care, housing, and employment needs that haunted the black community. But the onset of the Cold War and rising anti-communism allowed powerful Southerners to cast those rights as Soviet-inspired. Thus the Civil Rights Movement was launched with neither the language nor the mission it needed to truly achieve black equality.
